Thence Southeasterly along an arc of the Southerly <br />line of land of Norfolk & Western Railway Co., <br />63.81 ..... feet to the Easterly line of Henry Beach <br /> <br />ORDINANCE NO. 82-85 <br /> <br />BY: Brown, Chinnock, Gallagher, <br /> Graham, McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE accepting as a gift to the City of <br />Lakewood a deed for a parcel of land situated at or near Beach Parkway <br />in the City of Lakewood and known as Permanent Parcel No. 312-33-092. <br /> <br /> WHEREAS, pursuant to quit-claim deed No. 948016 recorded in <br />Volume 83-1049 Page 15 of Cuyahoga County Recorders Office records, <br />Jay H. Bramson transferred to the City of Lakewood a parcel of land <br />located at or near Beach Parkway which transfer has not been accepted <br />to date by the City, and <br /> <br /> WHEREAS, there is located upon said parcel a four car garage <br />which the Building Department of the City has determined to be in a <br />run down condition and unsafe and there is growing concern among <br />neighboring property owners as to the safety of children in the area, <br />and <br /> <br /> WHEREAS, Mr. John Krebs, an owner of a nearby apartment <br />building, has indicated a willingness and desire to purchase the <br />aforementioned parcel of property for the sum of $501.00 and in <br />addition will assume responsibility for all delinquent taxes and will <br />correct all Building violations outstanding against the property as <br />reported by the Building Department, and <br /> <br /> WHEREAS, this Council determines that it is in the best <br />interest of the City to now accept such parcel of land for the purpose <br />of transferring said property to John Krebs, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency <br />providing for the immediate preservation of the public health, <br />and welfare; now, therefore, <br /> <br />measure <br /> safety <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br /> <br />OF OHIO: <br /> <br /> Section 1. That this Council does hereby accept as a gift <br />to the City of Lakewood a deed for the following described premises <br />located at or near Beach Parkway in the City of Lakewood and known as <br />Permanent Parcel No. 312-33-92: <br /> <br />Situated in the City of Lakewood, County of <br />Cuyahoga and State of Ohio, indicated on the <br />County Auditor's Records as Permanent Number 312- <br />33-092, and known as being a part of S/L 39 and 40 <br />in Henry Beach Subdivision of part of Original <br />Rockport Township Section No. 21 as shown by the <br />recorded plat in Volume 30 of Maps, Page 4 of <br />Cuyahoga County Records, and bounded and described <br />as follows: <br /> <br />Beginning on the Easterly line of said Subdivision <br />at the point distant 765.51 feet Northerly from the <br />Northerly side of Detroit Avenue. (66.-feet wide), <br />and 96.67 feet Westerly from the Westerly side of <br />Fry Av. (40.-feet wide); <br /> <br />Thence Westerly at the right angle to the Easterly <br />line of Henry Beach Subdivision, 60.065 feet to a <br />point; <br /> <br />Thence Northerly, parallel with the Easterly line <br />of Henry Beach Subdivision, 98.15 feet to the <br /> <br /> <br />
