ORDINANCE NO. 83-85 <br /> <br />BY: Brown, Chinnock, Gallagher, <br /> Graham, McBride, Salmon, <br /> Wendling <br /> <br /> AN EMERGENCY ORDINANCE providing for the sale of certain <br />property at or near Beach Parkway and authorizing and directing the <br />Mayor to execute a quit-claim deed for and on behalf of the City of <br />Lakewood. <br /> <br /> WHEREAS, the property located at or near Beach Parkway known <br />as Parmanent Parcel No. 312-33-092 in the City of Lakewood upon which <br />is situated a four car garage, has been accepted by this Council as a <br />gift to the City, and <br /> <br /> WHEREAS, there is concern among neighboring property owners <br />regarding the condition of the garage structure and the safety of <br />children playing in the area, and <br /> <br /> WHEREAS, a prospective purchaser has agreed to correct the <br />Building violations currently outstanding on the premises and this <br />Council determines that it is in the best interest of the City of <br />Lakewood that said real property be sold to said purchaser, and <br /> <br /> WHEREAS, this Council has determined that the <br />further the interest of the City and its residents, and <br /> <br />sale will <br /> <br /> WHEREAS, this ordinance constitutes'an emergengy measure <br />providing for the immediate preservation of the public health, safety <br />and welfare, and for the usual daily operation of a municipal <br />department; now, therefore, <br /> <br />OF OHIO: <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br /> <br /> Section 1. It is hereby determined that the real property <br />known as Permanent Parcel No. 312-33-.092 situated in the City of <br />Lakewood is not needed for municipal purposes and it is in the best <br />interest of the City of Lakewood and its residents that said property <br />be sold. <br /> <br /> Section 2. That the Mayor is hereby authorized and directed <br />to execute on behalf of the City of Lakewood a quit-claim deed <br />transferring the interest of the City of Lakewood in the property <br />designated as Permanent Parcel No. 312-.33-092 to one John Krebs, 4105 <br />Diane Drive, Fairview Park, Ohio, 44126, for the consideration of <br />$501.00, said deed to be substantially in the form of Exhibit "A", <br />attached hereto and made a part hereof als if fully rewritten. <br /> <br /> Section 3. It is found and. determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />ordinance were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action, were in meetings open to the <br />public, in compliance with all legal requirements including Section <br />121.22 of the Ohio Revised Code. <br /> <br /> Section 4. That this ordinance is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and <br />provided it receives the affirmative vote of two-thirds of all members <br /> <br />1 <br /> <br /> <br />
