the Developer from any of its obligations hereunder. Any consent <br />by City to a sale, assignment, pledge, hypothecation, or transfer <br />of this Preliminary Agreement.shall apply only to the specific <br />transaction thereby authorized and shall not relieve Developer from <br />the requirement of obtaining the prior vritten consent of the City <br />to any further sale, assignment, pledge, hypothecation, or other <br />transfer of this Preliminary Agreement. In instances where the <br />consent of City is sought, contemporaneously with the request of <br />Developer therefor, Developer shall submit, in vriting, information <br />reasonably sufficient to enable City to decide with respect thereto. <br /> <br />Section 9. Amendment - Effective Date. <br /> <br /> (a) This Preliminary Agreement may be amended by the execu- <br />tion of a written instrument signed by the Mayor on behalf of the <br />City and the duly authorized representatives of the Developer. <br /> <br /> (b) This Preliminary Agreement is executed in duplicate (each <br />copy to be an original) by the undersigned and shall be effective <br />upon the execution of this Preliminary Agreement by the Mayor, on <br />behalf of the City, and by a duly authorized officer of the <br />Developer, on behalf of the Developer. <br /> <br />Approved as to form, substance, <br />and co_r~ness. <br /> <br />THE CITY OF LAKEWOOD, OHIO <br /> <br />THE ~JSTIN E.
