industrial revenue bonds; and to assist the Developer and/or other <br />developers in the Project Area in qualifying for and securing <br />federal and state loans and/or grants, with respect to redevelop- <br />ment of the Project Area. The City will not pledge its full faith <br />and credit or powers to levy taxes to secure any of the Developer's <br />or other developer's obligations in the Project Area. <br /> <br /> (e) The City w~ll consider tax abatement w~thin the Project <br />Area. <br /> <br /> (f) The City will review existing provisions of its Codified <br />Ordinances and consider changes thereto proposed by the Developer, <br />or others, with respect to its fees and charges ~ade in connection <br />with its regulatory codes for land uses that are to be contained in <br />the Project Area. <br /> <br /> (g) The City will review the need for public parking facili- <br />ties (surface and/or parking garages) based on the requirement of <br />the Project Area, and other adjacent areas and will consider the <br />relocation of existing and the provision of new parking facilities. <br />The City will also consider the need for public walkways, skywalks <br />and other means of access to the Project Area. Any such facilities <br />provided by the City will be. constructed as public improvements <br />that must be open to the general public. The City will consider the <br />use of tax increment financing, under circumstances permitted by <br />Law, to undertake and complete appropriate public improvements. <br />The City's ability to provide any needed facilities is subject to <br />the debt capacity of the City and the need to preserve that debt <br />capacity for other permanent improvements, the circumstances of the <br />bond market, and the Laws respecting debt issuances by the City. <br /> <br />Section 5. Development Agreement - Plans for Proposed Redevelopment. <br /> <br /> (a) Upon approval of the Preliminary Schematic Design and the <br /> Project Feasibility Study by the Mayor, on behalf of the City, and <br /> a duly authorized representative of the Developer, on behalf of the <br /> Developer, the Developer and the City shall negotiate in good <br /> faith, in an effort to reach agreement with respect to matters to <br /> be set forth in the Development Agreement, as provided in Section <br /> 2(a) of this Agreement. The Development Agreement shall set forth <br /> the terms and conditions of all obligations of the City and the <br /> Developer with respect to the Project Area. The Development Agree- <br /> ment shall include the Preliminary Plans, subject to the review and <br /> approval thereof by the City's planning and other regulatory bodies <br /> or officials. After approval of the Preliminary Plans by <br /> appropriate planning and other regulatory bodies or officials, the <br /> Developer shall present Final Plans to the City's appropriate <br /> officials for the consideration of the City with respect to the <br /> issuance of building permits. <br /> <br />-6- <br /> <br /> <br />
