ORDINANCE NO. 92-85 <br /> <br />BY: <br /> <br />Gallagher, Graham, McBride, <br />Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Mayor for and on <br />behalf of the'City of Lakewood to enter into a Lease Agreement with <br />Paul R. Zillman and Nancy J. Zillman, husband and wife, for premises <br />located at the northerly end of Cohassett Place in the City of <br />Lakewood, for the purpose of improving same as a yard and garden. <br /> <br /> WHEREAS, the <City is the owner of two parcels of land <br />situated at the northerly end of Cohassett Place and designated as <br />Permanent Parcel Nos. 312-31-82 and 312.-31-83, the southerly portion <br />being paved and used for off-street parking purposes with the <br />northerly portion unpaved; of no immediate value to the City and <br />requires unnecessary maintanence, and <br /> <br /> WHEREAS, there is concern among neighboring property owners <br />of the unauthorized entry and use of said vacant land, and <br /> <br /> WHEREAS, Mr. and Mrs. Zillman, the owners of a residence <br />situated on property abutting the aforementioned unpaved portion of <br />property owned by the City, have expressed an interest in 'leasing the <br />property for the purpose of maintaining a yard and garden thereon, and <br /> <br /> WHEREAS, this Council believes it would be in the best <br />interests of the City to lease the northern portion of Permanent <br />Parcels Nos. 312-31-82 and 312-31-83 to Mr. and Mrs. Zillman and that <br />same will further the interest of the City and its residents, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency <br />providing for the immediate preservation of the public health, <br />and welfare; now, therefore, <br /> <br />measure <br /> safety <br /> <br />OF OHIO: <br /> <br />BE iT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br /> <br /> Section 1. That Council hereby determines that the real <br />property located at the northerly end of Cohassett Place and further <br />described as the northerly portion of Permanent Parcel Nos. 312-31-82 <br />and 312-31-83 owned by the City should be leased to the abutting <br />property owner for the purpose of establishing a yard and garden <br />thereon and maintaining same and that the lease of said property is in <br />the best interests of the City and will.further the interests of the <br />City and its residents. <br /> <br /> Section 2. That the Mayor for and on behalf of the City is <br />hereby authorized and directed to enter into a one year term lease <br />agreement, renewable annually, with Paul R. Zillman and Nancy J. <br />Zillman, husband and wife, 1326 Thoreau Road, Lakewood, Ohio, for the <br />northerly portion of Permanent Parcel Nos. 312-31-82 and 312-31-83, <br />said lease to be substantially in the form of Exhibit "A" attached <br />hereto and made a part hereof as if fully rewritten herein. <br /> <br /> Section 3. It is found and determined that all formal actions <br />of this Council concerning and relating to the passage of this <br />ordinance were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action, were in meetings open to the <br />public, in compliance with all legal requirements including Section <br />121.22 of the Ohio Revised Code. <br /> <br /> Section 4. That this ordinance is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and <br /> <br /> <br />
