ORDINANCE NO. 92-85 BY: Gallagher, Graham, McBride, Salmon, Wendling AN EMERGENCY ORDINANCE authorizing the Mayor for and on behalf of the'City of Lakewood to enter into a Lease Agreement with Paul R. Zillman and Nancy J. Zillman, husband and wife, for premises located at the northerly end of Cohassett Place in the City of Lakewood, for the purpose of improving same as a yard and garden. WHEREAS, the <City is the owner of two parcels of land situated at the northerly end of Cohassett Place and designated as Permanent Parcel Nos. 312-31-82 and 312.-31-83, the southerly portion being paved and used for off-street parking purposes with the northerly portion unpaved; of no immediate value to the City and requires unnecessary maintanence, and WHEREAS, there is concern among neighboring property owners of the unauthorized entry and use of said vacant land, and WHEREAS, Mr. and Mrs. Zillman, the owners of a residence situated on property abutting the aforementioned unpaved portion of property owned by the City, have expressed an interest in 'leasing the property for the purpose of maintaining a yard and garden thereon, and WHEREAS, this Council believes it would be in the best interests of the City to lease the northern portion of Permanent Parcels Nos. 312-31-82 and 312-31-83 to Mr. and Mrs. Zillman and that same will further the interest of the City and its residents, and WHEREAS, this ordinance constitutes an emergency providing for the immediate preservation of the public health, and welfare; now, therefore, measure safety OF OHIO: BE iT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE Section 1. That Council hereby determines that the real property located at the northerly end of Cohassett Place and further described as the northerly portion of Permanent Parcel Nos. 312-31-82 and 312-31-83 owned by the City should be leased to the abutting property owner for the purpose of establishing a yard and garden thereon and maintaining same and that the lease of said property is in the best interests of the City and will.further the interests of the City and its residents. Section 2. That the Mayor for and on behalf of the City is hereby authorized and directed to enter into a one year term lease agreement, renewable annually, with Paul R. Zillman and Nancy J. Zillman, husband and wife, 1326 Thoreau Road, Lakewood, Ohio, for the northerly portion of Permanent Parcel Nos. 312-31-82 and 312-31-83, said lease to be substantially in the form of Exhibit "A" attached hereto and made a part hereof as if fully rewritten herein. Section 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action, were in meetings open to the public, in compliance with all legal requirements including Section 121.22 of the Ohio Revised Code.
