1121.08 SPECIAL EXCEPTION PARKING <br /> <br />The Board of Zoning Appeals may permit as a Special Exception, <br />subject to the concurrence of City Council, the use of land in <br />the R1, R2, M1 and M2 district contiguous to a BR- <br />Business/Residential, Bi-Office, and X-Industrial distict for <br />off-street parking spaces for customers and employees, and permit <br />the parking of educational trailers and/or educational vehicles, <br />whether on wheels or foundation for use by schools teaching <br />students in grades KindergarSen through twelfth grade, in any R1, <br />R2, Mi and M2 district, provided it finds the conditions <br />hereinafter specified are met: <br /> <br />(a) <br /> <br />The Board shall hold a public hearing on the request and <br />written notice shall be mailed to all property owners within <br />200 feet of proposed lot stating property involved, time, <br />date, and place where hearing will be held. <br /> <br />(b) <br /> <br />The Board shall determine that the applicant is the owner or <br />owner's agent of the property in question and that the owner <br />will, in writing, agree to comply with such conditions and <br />restrictions as may be imposed by the Board and all <br />applicable ordinances. <br /> <br />(c) <br /> <br />The Board affirmatively finds that the conditions and <br />restrictions as it may impose, will not result in <br />substantial detriment to neighboring property. <br /> <br />(d) <br /> <br />In establishing conditions and restrictions, if any, the <br />Board shall consider, for the protection of the neighborhood <br />and safety and protection of children using educational <br />trailers and/or educational vehicles, the length of time for <br />construction, maintenance, screening, fences, walls, <br />landscaping, lighting, evening use, need for landscape space <br />15 feet wide between sidewalk and parking lot, and uses <br />other than parking for customers and employees, provided <br />that the design of the proposed parking area has been <br />approved by the Architectural Board of Review. <br /> <br />(e) <br /> <br />If City Council fails to concur with the recommendations of <br />either or both the Architectural Board of Review and the <br />Board of Zoning Appeals, then it will direct the matter back <br />to the appropriate Board. <br /> <br /> <br />
