ORDINANCE NO. 118-86 BY: Brown, Chinnock, Gallagher, Graham, Salmon, Wendling AN ORDINANCE to supplement part 13 of the Building Code the Codified Ordinances of the City of Lakewood by adopting enacting a new Chapter 1307 entitled Flood Damage Prevention Code. of and WHEREAS, Article XVIII, Section 3 of the Ohio Constitution grants to municipalities the legal authority to adopt land use and control measures for promoting the health, safety and general welfare of its citizens, and WHEREAS, pursuant to such authority, the City adopted a Flood Damage Prevention Code on January 16, 1978, and WHEREAS, in September, 1986, the Federal Insurance Administration advised all participating communities of certain revisions to the participation requirements of the National Flood Insurance Program (NFIP), and WHEREAS, all flood prone communities have been informed that they must include the new requirements into their existing Flood Plain Management ordinances or face suspension from the NFIP, and WHEREAS, it has been suggested that it would be more practical for the communities to substitute an entirely new ordinance for our existing regulations rather than to amend the various parts of the e~isting Code; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, OHIO: STATE OF Section 1. That part 13 of Building Code of the Codified Ordinances of the City of Lakewood, Ohio, be and the same is hereby supplemented by adopting and enacting new Chapter 1307 entitled "Flood Damage Prevention Code" to read as follows: CHAPTER 1307 FLOOD DAMAGE PREVENTION CODE 1307.01 TITLE. The provisions of this Chapter, hereinafter referred to as this "Code" shall be known as the Flood Damage Prevention Code of the City of Lakewood. 1307.02 FINDINGS OF FACT. (a) The flood hazard areas of Lakewood are subject to periodic inundation which may result in loss of life and property, health and safety hazards, disruption of commerce and governmental services, extraordinary public expenditures for flood protection and relief, and impairment of the tax base, all of which adversely affect the public health, safety and general welfare. (b) These flood losses are caused by the cumulative effect of obstructions in areas of special flood hazards which increase flood heights and velocities and, when inadequately anchored, 1
