ORDINANCE NO. <br /> <br />118-86 <br /> <br />BY: Brown, Chinnock, Gallagher, <br /> Graham, Salmon, Wendling <br /> <br /> AN ORDINANCE to supplement part 13 of the Building Code <br />the Codified Ordinances of the City of Lakewood by adopting <br />enacting a new Chapter 1307 entitled Flood Damage Prevention Code. <br /> <br /> of <br />and <br /> <br /> WHEREAS, Article XVIII, Section 3 of the Ohio Constitution <br />grants to municipalities the legal authority to adopt land use and <br />control measures for promoting the health, safety and general welfare <br />of its citizens, and <br /> <br /> WHEREAS, pursuant to such authority, the City adopted a <br />Flood Damage Prevention Code on January 16, 1978, and <br /> <br /> WHEREAS, in September, 1986, the Federal Insurance <br />Administration advised all participating communities of certain <br />revisions to the participation requirements of the National Flood <br />Insurance Program (NFIP), and <br /> <br /> WHEREAS, all flood prone communities have been informed that <br />they must include the new requirements into their existing Flood Plain <br />Management ordinances or face suspension from the NFIP, and <br /> <br /> WHEREAS, it has been suggested that it would be more <br />practical for the communities to substitute an entirely new ordinance <br />for our existing regulations rather than to amend the various parts of <br />the e~isting Code; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />OHIO: <br /> <br />STATE OF <br /> <br /> Section 1. That part 13 of Building Code of the Codified <br />Ordinances of the City of Lakewood, Ohio, be and the same is hereby <br />supplemented by adopting and enacting new Chapter 1307 entitled "Flood <br />Damage Prevention Code" to read as follows: <br /> <br />CHAPTER 1307 <br /> <br />FLOOD DAMAGE PREVENTION CODE <br /> <br />1307.01 TITLE. <br /> <br />The provisions of this Chapter, hereinafter <br />referred to as this "Code" shall be known as the <br />Flood Damage Prevention Code of the City of <br />Lakewood. <br /> <br />1307.02 FINDINGS OF FACT. <br /> <br />(a) The flood hazard areas of Lakewood are subject <br />to periodic inundation which may result in loss of <br />life and property, health and safety hazards, <br />disruption of commerce and governmental services, <br />extraordinary public expenditures for flood <br />protection and relief, and impairment of the tax <br />base, all of which adversely affect the public <br />health, safety and general welfare. <br /> <br />(b) These flood losses are caused by the <br />cumulative effect of obstructions in areas of <br />special flood hazards which increase flood heights <br />and velocities and, when inadequately anchored, <br /> <br />1 <br /> <br /> <br />
