to the Easterly line of said Sublot No. 54; thence <br />due North along said Easterly line, 10 feet to the <br />center line of said driveway; thence due West <br />along said center line, 235.13 feet to the <br />Easterly line of Beach Avenue; thence due South <br />along said Easterly line, 10 feet to the place of <br />beginning, as appears by said plat, be the same <br />more or less but subject to all legal highways. <br /> <br />Owners Edna M. Wick and Viola Schafer. <br /> <br /> Section 2. That the Director of Law be and he is hereby <br />authorized and directed to apply to a court of competent jurisdiction <br />to have a jury empaneled to make inquiry into and assess the <br />compensation to be paid for the fee simple interest in said property. <br /> <br /> Section 3. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />ordinance were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action, were in meetings open to the <br />public, in compliance with all legal requirements including Section <br />121.22 of the Ohio Revised Code. <br /> <br /> Section 4. That this ordinance is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and <br />provided it receives the affirmative vote of two-thirds of all members <br />elected to Council, it shall take effect and be in force immediately <br />upon its adoption and approval by the Mayor; otherwise, it shall take <br />effect and be in force after the earliest period allowed by-l~w. <br /> <br />ENT ~ <br /> <br />CLERK <br /> <br />Approved~~~+~~__ <br /> <br /> <br />
