ORDINANCE NO: 49-86 <br /> <br />BY: Brown, Chinnock, Gallagher, <br /> McBride, Graham, Salmon <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Public Works <br />Director to advertise for bids and to enter into a contract <br />with the lowest and best bidder after advertisement according <br />to law for the installation of a new water main on Roycroft <br />Avenue between Detroit Avenue and Franklin Avenue in the City <br />of Lakewood. <br /> <br /> WHEREAS, Council has determined the water main on <br />Roycroft Avenue between Detroit Avenue and Franklin Avenue <br />is badly deteriorated and in urgent need of replacement, and <br /> <br /> WHEREAS, Council has authorized the preparation <br /> of construction drawings and specifications by the Lakewood <br />Engineering Department, and <br /> <br /> WHEREAS, <br />and specifications <br />office, and <br /> <br />the aforementioned construction drawings <br />are now on file in the City Engineer's <br /> <br /> WHEREAS, this Ordinance constitutes an emergency <br />measure providing for the usual daily operation of a municipal <br />department and for the immediate preservation of the public <br />safety and welfare; now, therefore <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That the Public Works Director be and <br />he is hereby authorized and directed to advertise for bids <br />and to enter into a contract with the lowest and best bidder <br />after advertisement according to law for the installation <br />of a new water main on Roycroft Avenue between Detroit Avenue <br />and Franklin Boulevard in the City of Lakewood. <br /> <br /> Section 2. That the cost of such construction is <br />estimated at $150,000, which funds are to be made available <br />from the Water Fund and Community Development Block Grant <br />Fund. <br /> <br /> Section 3. It is found and determined that all <br />formal actions of this Council concerning and relating to <br />the passage of this ordinance were adopted in an open meeting <br />of this Council, and that all such deliberations of this Council <br />and of any of its committees that resulted in such formal <br />action, were in meetings open to the public, in compliance <br />with all legal requirements including Section 121.22 of the <br />Ohio Revised Code. <br /> <br /> Section 4. That this Ordinance is hereby declared <br />to be an emergency measure for the reasons stated in the <br />preamble hereof and provided it receives the affirmative vote <br />of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately upon its adoption <br />and approval by the Mayor; otherwise it shall take effect <br />and be in force after, the earliest per~~o~'~aw. <br /> <br />Adopted: <br /> ~sident ~ <br /> <br />Approved: F~~~ /~' <br /> <br />Clerk <br /> <br /> <br />
