ORDINANCE NO. 52-86 <br /> <br />BY:Brown, Chinnock, Gallagher, Graham, <br /> McBride, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the mayor <br />to engage special consultants to assist in evaluatin9 the request <br />of Cox Cable Clevelan~ ~re~, ]~c. for the renewal of its cable franchise. <br /> <br /> WHEREAS, Cox Cable Cleveland Area, Inc. has submitted to <br />the City of Lakewood a proposal for a renewal of its franchise with <br />the City of Lakewood, and <br /> <br /> WHEREAS, in order to properly evaluate such request, this <br />Council determines that the employment of consultants to advise it <br />in such matter is necessary and advisable, and <br /> <br /> WHEREAS, the firm of Pierson, Ball & Dowd, Attorneys At Law, <br />has been examined and found adequate and satisfactory to discharge <br />such task, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public welfare and <br />for the further reason that such consultants should be retained at <br />the earliest possible time; now, therefore, <br /> <br /> BE IT ORDAI~'iED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br />OF OHIO: <br /> <br /> Section 1. That the iqayor be and he is hereby authorized <br />and directed to engage the firm of Pierson,, Ball & Dowd, Attorneys At Law, <br />as consultant to assist in evaluating the request and proposal from <br />Cox Cable Cleveland Area, Inc. for a renewal of its franchise with <br />the City of Lakewood. <br /> <br /> Section 2. That the fees for such consultant shall not exceed <br />the sum of Twenty-Thousand ($20,000) Dollars and shall be paid from <br />the General Fund. <br /> <br /> Section 3. It is found and determined that all formal actions <br />of this Council concerning and relating to the passage of this ordinance <br />were adopted in an open meeting of this Council, and that all such <br />deliberations of this Council and of any of its commi%tees that resulted <br />in such formal action were in meetings open to the public, in compliance <br />with all legal requirements including Section 121.22 of the Ohio Revised <br />Code. <br /> <br /> Section 4.
