ORDINANCE NO. 58-86 <br /> <br />BY: Brown, ~allagher, Graham, McBride, <br /> Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Mayor <br />for and on behalf of the City of Lakewood to enter into an Agreement <br />with the Board of Education of the Lakewood City School District to <br />provide for the sharing of expenses relating to the administration and <br />defense of claims arising out of the recreational programs of the <br />City. <br /> <br /> WHEREAS, the Board of Education comducts the general <br />recreation program throughout the City and the City' has entered into <br />agreements with the Board for the joint operation of recreational <br />facilities, and <br /> <br /> WHEREAS, the insurance carrie~ of the Board of Education has <br />determined not to renew the comprehensi, ve l~a~ility insurance policy <br />of the ~oard which policy in, cured the Board and its employees against <br />suits, causes of actions, claims and damages which may arise out of <br />the operation of the recreational programs on City oWned property, and <br /> <br /> WHEREAS, it is in the best intereSt of the <br />welfare of the citizens of this community to have the <br />program continued, and <br /> <br /> health and <br />recreational <br /> <br /> WHEREAS, the City and the Board of Education desire to meet <br />such interest by prowiding for the sharing of expenses relating to the <br />administration and defense of all claims arising out of or connected <br />with the recreational programs of the City, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public welfare and for <br />the usual daily operation of a municipal department; now, therefore, <br /> <br />OF OHIO: <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br /> <br /> Section 1. That the Mayor be and he is hereby authorized <br />and directed for and on behalf of the City of Lakewood to enter into <br />an Agreement with the Board of Education of the Lakewood City School <br />District which Agreement shall be substantially as set forth in <br />Exhibit "A" attached hereto and made a part hereof with such changes <br />therein as are not substantially adverse to the City of Lakewood and <br />as approved by the Mayor. <br /> <br /> Section 2. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />ordinance were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action, were in meetings open to the <br />public, in compliance with all legal requirements including Section <br />121.22 of the Ohio Revised Code. <br /> <br /> Section 3. That this ordinance is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and <br />provided ~t receives the affirmative vote of two-thirds of all members <br />elected to Council, it shall take effect and be in force immediately <br />upon its adoption and approval by the Mayor; otherwise, ~1 take <br />effect and be in force after the earlies~~ <br /> <br />Approved :/ ,~ ~ /~/ / ~~ <br /> <br /> <br />
