Please Substitute for Ordinance <br />No. 69-86 in Docket of 6/16/86. <br /> <br />ORDINANCE NO: 69-86 <br /> <br />BY: Brown, Gallagher, Graham, McBride, <br /> Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Director of Public Works <br />to advertise for bids and to enter into a contract with the lowest <br />and best bidder after advertisement according to law for a new Bath <br />House and the Renovation of Foster Pool in the City of Lakewood. <br /> WHEREAS, Council has determined the existing bath house, gutter <br />and drainage system are badly deteriorated, and <br /> WHEREAS, this Council has authorized the preparation of <br />construction drawings and specifications by George L. Draeger and <br />Associates, and <br /> WHEREAS, the aforementioned construction drawings and <br />specifications are now on file in the City Engineer's office, and <br /> WHEREAS, this Ordinance constitutes an emergency measure providing <br /> for the usual daily operation of a municipal department and for the <br /> immediate preservation of the public safety and welfare; now, therefore <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br /> OF OHIO: <br /> <br /> Section 1. That the Director of Public Works be and he is hereby <br />authorized and directed to advertise for bids and to enter into a <br />contract after approval by Council, with the lowest and best bidder <br />after advertisement according to law for a new Bath House and the <br />Renovation of Foster Pool in the City of Lakewood. <br /> <br /> Section 2. That the cost of such construction is estimated <br />at $1,100,000 which funds are to be made available from the Recreation <br />Improvement Fund. <br /> Section 3. It is found and determined that all formal actions <br />of this Council concerning and relating to the passage of this <br />ordinance were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action, were in meetings open to the <br />public, in compliance with all legal requirements including Section <br />121.22 of the Ohio Revised Code. <br /> Section 4. That this Ordinance is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and <br />provided it receives the affirmative vote of two-thirds of all members <br />elected to Council, it shall take effect and be in force immediately <br />upon its adoption and approval by the Mayor; otherwise it shall take <br />effect and be in force after the earliest period allowed by law. <br /> <br />Adopted: <br /> <br />P <br /> <br />Approved: ~t~/fT/ {f~' <br /> <br />Clerk <br /> <br /> <br />
