ORDINANCE NO. 70-86 <br /> <br />BY: Brown, Gallagher, Graham, McBride, <br /> Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE to supplement Section 905.02 of the <br />Streets and Public Service Code of the Codified Ordinance of the City <br />of Lakewood by enacting new paragraph (e) to establish the hours for <br />the usage of the Fishing Platform at Lakewood Park. <br /> WHEREAS, paragraph (b) of Section 905.02 of the Streets and <br />Public Services Code provides that City Parks shall be closed to the <br />public between the hours of ll:O0 pom. and Sunrise and, <br /> WHEREAS, access to the fishing platform at Lakewood Park is not <br /> available until the Park Guard comes on duty at 6:00 a.m. and the <br /> Platform should be closed for use until that time, and, <br /> WHEREAS, this Ordinance constitutes an emergency measure provid- <br /> ing for the usual daily operation of a municipal department, now, <br /> therefore: <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF <br /> OHIO: <br /> Section 1. That Section 905.02 of the Streets and Public <br /> Service Code of the Codified Ordinances of the City of Lakewood shall <br /> be and the same is hereby supplemented by enacting new paragraph (e) <br /> to read as follows: <br /> <br />905.03 - HOURS OPEN TO PUBLIC: <br /> <br />(a) <br /> <br />(b) <br /> <br />(c) <br /> <br />(d) <br />(e) No person, other than an on-duty employee of the City of <br />Lakewood shall enter into or remain within that area of Lakewood <br />Park, north of the existing most-northerly fence line, between <br />the hours of ll:O0 p.m. and 6:00 a.m. and at such times as the <br />Superintendent of the Division of Buildings and Grounds deems it <br />necessary due to special events and/or weather conditions. Spe- <br />cial permission may be granted in writing to persons to use this <br />area by the Director of Public Safety or the Director of Public <br />Works. <br /> <br /> Section 2. It is found and determined that all formal actions <br />of this Council concerning and relating to the passage of this <br />Ordinance were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and Of any of its committees <br />that resulted in such formal action, Were in meetings open to the <br />public, in compliance with all legal requirements including Section <br />121.22 of the Ohio Revised Code. <br /> <br /> <br />
