ORDINANCE NO. 3-87 BY:Brown, Chinnock, Galllagher, <br /> Graham, McBride, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE repealing Section 769.07 of the <br />Business Regulation Code of the Codified Ordinances of the City of <br />Lakewood relating to the requirements for the issuance of taxicab <br />drivers' licenses to females. <br /> <br /> WHEREAS, Section 769.07 of Chapter 769 entitled "Taxicabs" <br />of the Business Regulation Code of the Codified Ordinances of the City <br />of Lakewood provides for time limits during which female taxicab <br />drivers may operate their cabs and for other reasonable regulations as <br />the Director of Public Safety shall determine to be necessary, and <br /> <br /> WHEREAS, this Council concurs with the findings of its <br />Commercial Development Committee that such Code provision is <br />discriminatory and should be repealed forthwith, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public safety and <br />welfare; now, therefore, <br /> <br />OF OHIO: <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br /> <br /> Section 1. That Section 769.07 of the Business Regulation <br />Code of the Codified Ordinances of the City of Lakewood, now reading <br />as follows: <br /> <br />769.07 REQUIREMENTS <br /> FEMALES. <br /> <br />FOR ISSUANCE OF LICENSE TO <br /> <br />The Director of Public Safety is hereby authorized <br />to issue a taxicab driver's license to any female <br />applicant therefor who shall comply with the <br />requirements of this chapter, provided that such <br />license shall limit the time during which such <br />female may operate thereunder to the period <br />beginning at 6:00 a.m. and ending at 8:00 p.m. and <br />that it shll be subject to such further reasonable <br />regulations as the Director of Public Safety shall <br />determine to be necessary for the safety and <br />protection of such licensees and the public. <br /> <br />shall be and the same is hereby repealed. <br /> <br /> Section 2. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />ordinance were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action, were in meetings open to the <br />public in compliance with all legal requirements. <br /> <br /> Section 3. That this ordinance is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and <br />provided it receives the affirmative vote of two-thirds of all members <br />elected to Council, it shall take effect and be in force immediately <br />upon its adoption and approval by the Mayor; otherwise, it shall take <br />effect and be in force after the <br /> <br />Adopted: ~ /..~/ /~d~' <br /> <br />Approve~/~~ ~O./ ./~7. _ . <br /> <br />earliest period allowed b~-~w~. <br /> <br /> <br />
