ORDINANCE NO. 11-87 ~. BY: Brown, Chinnock, Gallagher, <br /> Graham, McBride, Salmon, Wendling <br />AN EMERGENCY ORDINANCE to repeal Section 149.17 of the <br />Administrative Code of the Codified Ordinances of the City of Lakewood <br />relating to residence requirements for City employees. <br /> <br /> WHEREAS, the terms and conditions of Section 149.17 of the <br />Administrative Code of the Codified Ordinances of the City of Lakewood <br />are impractical for the daily operation of City departments and same <br />should be repealed, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the usual daily operation of a municipal department; <br />now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br /> <br />OF OHIO: <br /> <br />of the <br />follows: <br /> <br /> Section 1. That Section 149.17 of the Administrative Code <br />Codified Ordinances of the City of Lakewood now reading as <br /> <br />149.17 RESIDENCE REQUIREMENTS. <br /> <br />(a) Except as the Charter may otherwise <br />specifically provide, no person who bas been in the <br />employ of the City for a period of at least one <br />year shall be required by or pursuant to any order, <br />rule or other action adopted or taken by any <br />official, board or commission of the City, to <br />reside within the territorial limits of the City of <br />Lakewood as a condition to: <br /> <br />(1) <br />(2) <br /> <br />(3) <br /> <br />Continuing such emplyment. <br />Becoming or being an applicant for admission <br />to any promotional examination; or <br />Being listed on any civil service lists for <br />promotion to .higher rank to which list such <br />person would otherwise be eligible. <br /> <br />(b) No person in the employ of the City shall <br />reside outside of that portion of Cuyahoga County <br />which is located westerly of the Cuyahoga River, <br />unless, with respect to the members of the Division <br />of Police and the Division of Fire, the rules and <br />regulations of such Divisions provide otherwise. <br /> <br />shall be and the same is hereby repealed. <br /> <br /> Section 2. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />ordinance were adopted in an open meeting of this Council, and that. <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action were in meetings open to the <br />public in compliance with all legal requirements. <br /> <br />Section 3. That ithis ordinance is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and <br />provided it receives the affirmative vote of two-thirds of all members <br />elected to Council, it shall take effect and be in forc~---~ediately <br />upon its adoption and approval by the Mayor; otherw/~~t sh~ll take <br />effect and be in force after the earliest ! ~. <br /> , <br /> <br />Approved <br /> <br />1 <br /> <br /> <br />
