©RDIqANCE NO. 47-87 BroWn, Ch~nnock, Ga~l~gher, Graham, McBride, Salmon~ Wendl AN EMERGENCY ORDINANCE approving a Collective Bargaining Agreement with Ohio Council 8 and Local 1043 of the American Federation of State, County and Municipal Employees ALF-CIO, establishing conditions of employment, working conditions and various benefits for certain employees of the.Department of Public Works of the City of Lakewood, and authorizing the Mayor to sign said Agreement on behalf of the City. WHEREAS, a prior Collective Bargaining Agreement entered into between the City of Lakewood and Ohio Council 8 and Local 1043 of the American Federation of State, County and Municipal Employees AFL- CIO, terminated on February 28, 1987, and WHEREAS, discussions and negotiations have been continued subsequent on behalf of the City with representatives of Local Union 1043 and Ohio Council 8 with respect to conditions of employment, working conditions and various benefits for certain employees of the Department of Public Works of the City of Lakewood, and WHEREAS, an agreement has been reached in the course of said discussions and negotiations with respect to the conditions of employment, working conditions and various benefits for certain employees aforementioned, and WHEREAS, this Council determines that it is in interest of the City to approve said Collective Bargaining and authorize the Mayor to sign same on behalf of the Lakewood, and the best Agreement City of WHEREAS, this ordinance constitutes an emergency measUre providing for the immediate preservation of the public health, safety and welfare and for the usual daily operation of a municipal department and further for the reason that it is necessary to approve said Agreement at the eariest possible time; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Collective Bargaining Agreement with Ohio Council 8 and Local 1043 of te American Federation of State, County and Municipal Employees ALF-CIO, effective for the period of March 1, 1987, through February 28, 1990, an original copy of which~ is on file in the Office of the Mayor of the City of Lakewood and is made a part hereof as though written fully herein, is hereby adopted, ratified and approved and the Mayor is hereby authorized and directed for and on behalf of the City of Lakewood to affix his signature thereto. Section 2. That all other ordinances or resolutions or parts of ordinances or resolutions which are inconsistent with the provisions of this ordinance and/or the Collective Bargaining Agreement made a part hereof, are hereby repealed as of March 1, 1987, to the extent that they pertain to the employees in the bargaining unit covered by the Collective Bargaining Agreement and are inconsistent with this ordinance, including the Collective Bargaining Agreement referred to herein and made a part hereof. Section 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees tha~i~ resulted io such fore, al action were in meetings open 'to ~he public in compliance with all legal requirements. 1
