ORDINANCE NO. <br /> <br />55~87 <br /> <br />By: Brown, Gallagher, Graham, <br /> Salmon, Wendling <br /> <br />AN EMERGENCY ORDINANCE establishing the City of <br />Lakewood, Ohio Recreational Programs and Recreational <br />Facilities Self-Insurance Fund, pursuant to the <br />agreement entered into by and between the City of <br />Lakewood and the Lakewood City School District, and <br />to make an appropriation of funds in connection <br />therewith. <br /> <br /> WHEREAS, the City of Lakewood, Ohio (the "City") and the Board <br />of Education (the "Board") of the Lakewood City School District (the <br />"School District") have previously entered into a Recreational Program <br />and Facilities Self-Insurance Agreement dated June 11, 1987 (the "Agree- <br />ment''), which Agreement provides for the City and School District to <br />each establish a self-insurance fund; and <br /> <br /> WHEREAS, Section 2744.08(A)(2)(a), Ohio Revised Code, provides <br />that each political subdivision may establish a special fund for the <br />purpose of reserving monies with respect to its self-insurance programs; <br />and <br /> <br /> WHEREAS, this ordinance is an 'emergency measure which is <br />necessary for the immediate preservation of the public peace, property, <br />health, safety and welfare in the City, and for the further reason that <br />the self-insurance fund hereinabove described must be immediately estab- <br />lished and an appropriation of money thereto is immediately required to <br />enable the City to meet the requirements and the conditions imposed on <br />the City pursuant to the Agreement. <br /> <br /> NOW, THEREFORE, BE IT ORDAINED by the City of Lakewood, <br />Cuyahoga County, Ohio: <br /> <br /> Section 1. (a) That there is hereby established, pursuant to <br />Section 2744.08(A)(2)(a), Ohio Revised Code, a special fund to be known <br />as the "City of Lakewood, Ohio Recreational Programs and Recreational <br />Facilities Self-Insurance Fund" (hereinafter and otherwise referred to <br />as the "Recreational Self-Insurance Fund"). <br /> <br /> (b) The Recreational Self-Insurance Fund shall be adminis- <br />teredin accordance with the Agreement as the Agreement shall be amended <br />from time to time, as authorized by Section 2744.08(A)(2)(b), Ohio <br />Revised Code. <br /> <br /> (c) The source and amount of the monies to be deposited to <br />the credit of the Recreational Self-Insurance Fund shall be determined <br />in accordance with the Agreement, as it may be amended from time to <br />time. <br /> <br /> (d) The purposes of expenditures and other uses of monies and <br />the authority to expend monies from the Recreational Self-Insurance Fund <br />shall be determined in accordance with the Agreement, as it may be <br />amended from time to time, including but not limited to the purposes of <br />(i) paying claims whether by settlement or pursuant to a final judgment, <br />(ii) expenses, including but not limited to claims related expenses <br /> <br /> <br />
