ORDINANCE NO. 55~87 By: Brown, Gallagher, Graham, Salmon, Wendling AN EMERGENCY ORDINANCE establishing the City of Lakewood, Ohio Recreational Programs and Recreational Facilities Self-Insurance Fund, pursuant to the agreement entered into by and between the City of Lakewood and the Lakewood City School District, and to make an appropriation of funds in connection therewith. WHEREAS, the City of Lakewood, Ohio (the "City") and the Board of Education (the "Board") of the Lakewood City School District (the "School District") have previously entered into a Recreational Program and Facilities Self-Insurance Agreement dated June 11, 1987 (the "Agree- ment''), which Agreement provides for the City and School District to each establish a self-insurance fund; and WHEREAS, Section 2744.08(A)(2)(a), Ohio Revised Code, provides that each political subdivision may establish a special fund for the purpose of reserving monies with respect to its self-insurance programs; and WHEREAS, this ordinance is an 'emergency measure which is necessary for the immediate preservation of the public peace, property, health, safety and welfare in the City, and for the further reason that the self-insurance fund hereinabove described must be immediately estab- lished and an appropriation of money thereto is immediately required to enable the City to meet the requirements and the conditions imposed on the City pursuant to the Agreement. NOW, THEREFORE, BE IT ORDAINED by the City of Lakewood, Cuyahoga County, Ohio: Section 1. (a) That there is hereby established, pursuant to Section 2744.08(A)(2)(a), Ohio Revised Code, a special fund to be known as the "City of Lakewood, Ohio Recreational Programs and Recreational Facilities Self-Insurance Fund" (hereinafter and otherwise referred to as the "Recreational Self-Insurance Fund"). (b) The Recreational Self-Insurance Fund shall be adminis- teredin accordance with the Agreement as the Agreement shall be amended from time to time, as authorized by Section 2744.08(A)(2)(b), Ohio Revised Code. (c) The source and amount of the monies to be deposited to the credit of the Recreational Self-Insurance Fund shall be determined in accordance with the Agreement, as it may be amended from time to time. (d) The purposes of expenditures and other uses of monies and the authority to expend monies from the Recreational Self-Insurance Fund shall be determined in accordance with the Agreement, as it may be amended from time to time, including but not limited to the purposes of (i) paying claims whether by settlement or pursuant to a final judgment, (ii) expenses, including but not limited to claims related expenses
