523.99 VIOLATIONS AND PENALTIES. <br /> <br />(a) It shall be unlawful fur any person or <br />organization who owns, man~ges, operates or <br />otherwise controls the use of any establishment <br />subject to the restrictions of this Chapter to <br />fail to comply with its provisions, except that no <br />violation of this division shall be presumed <br />solely on the basis of violations of division (b) <br />of Section 523.99. <br /> <br />(b) It shall be unlawful for any person to <br />in any area restricted by the provisions of <br />Chapter. <br /> <br />smoke <br /> this <br /> <br />(c) Any person or organization w~o violates any <br />provision of this Chapter is guilty of a minor <br />misdemeanor. <br /> <br />(d) Each day on which a violation of any <br />provision of this Chapter occurs is a separate and <br />distinct offense and shall, be punishable as such. <br /> <br /> Section 2. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />ordinance were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action were in meetings open to the <br />public in compliance with all legal requirements. <br /> <br /> Section 5.
