Placed on First Reading on July 6, 198 <br />Placed on Second Reading on July 20, 19~ <br /> <br />ORDINANCE NO. 59-87 <br /> <br />BY: Brown, Chinnock, Gallagher, <br /> Graham, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE to vacate that portion of West Shore <br />Court situated west of 15710 West Shore Court (Permanent Parcel No. <br />311-13-54) in the City of Lakewood, Ohio. <br /> <br /> WHEREAS, on the fourth day of May, 1987, the Council of the <br />City of Lakewood adopted Resolution No. 6141-87 declaring its intent <br />to vacate a portion of West Shore Court, and <br /> <br /> WHEREAS, notice of the adoption of the above Resolution No. <br />6141-87 has been served upon the owners of all of the property <br />abutting West Shore Court affected by said resolution notifying said <br />property owners of the time and place at which objections could be <br />heard before the Board of Revision of Assessments, and <br /> <br /> WHEREAS, on the 15th day of June, 1987, the Board of <br />Revision of Assessments approved vacation of a portion of West Shore <br />Court hereinafter more particulary described in accordance with the <br />provisions of Article XIV, Section 28 of the Amended Charter of the <br />City of Lakewood, and <br /> <br /> WHEREAS, this Council is satisfied that there is good cause <br />for vacating a portion of West Shore Court and that it will not be <br />deterimental to the general interest and ought to be made, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the usual daily operation of a municipal department; <br />now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br />OF OHIO: <br /> <br /> Section 1. That the following described property be and the <br />same is hereby vacated: <br /> <br />SITUATED in the City of Lakewood, County of <br />Cuyahoga and State of Ohio and known as being a <br />part of Sublot No. 12 in the J. J. Donovan Realty <br />Co's Subdivision of Block "A" of The Hiram Barrett <br />Re-Subdivision of a part of Original Rockport <br />Township Section No. 22, as Recorded in Volume 35 <br />Page 15 of Cuyahoga County Map Records and bounded <br />and described as follows: <br /> <br />Beginning at an iron pipe set in the Southeasterly <br />corner of said Sublot No. 12, thence Westerly <br />along the Southerly line of said SUblot No. 12, a <br />distance of 80 feet to the Southwesterly corner of <br />said Sublot No. 12; thence Northerly along the <br />Westerly line of said Sublot No. 12, a distance of <br />15.50 feet; thence Easterly and parallel with the <br />Southerly line of said Sublot No. 12 and distant <br />15.50 feet at right angles Northerly therefrom, a <br />distance of 80 feet to the Easterly line of said <br />Sublot No. 12; thence Southerly along the Easterly <br />line of said Sublot No. 12~ a distance of 15.50 <br />feet to the place of beginning. Be the same more or <br />less, but subject to all legal highways. <br /> <br /> Section 2. That the Clerk of Council be and she is hereby <br />authorized and directed to notify the Auditor of Cuyahoga County of <br />the vacation of the hereinbefore described property by forwarding to <br />him a certified copy of the within ordinance together with a duly <br />certified vacation plat. <br /> <br /> <br />
