Placed on First Reading on July 6, 198 Placed on Second Reading on July 20, 19~ ORDINANCE NO. 59-87 BY: Brown, Chinnock, Gallagher, Graham, Salmon, Wendling AN EMERGENCY ORDINANCE to vacate that portion of West Shore Court situated west of 15710 West Shore Court (Permanent Parcel No. 311-13-54) in the City of Lakewood, Ohio. WHEREAS, on the fourth day of May, 1987, the Council of the City of Lakewood adopted Resolution No. 6141-87 declaring its intent to vacate a portion of West Shore Court, and WHEREAS, notice of the adoption of the above Resolution No. 6141-87 has been served upon the owners of all of the property abutting West Shore Court affected by said resolution notifying said property owners of the time and place at which objections could be heard before the Board of Revision of Assessments, and WHEREAS, on the 15th day of June, 1987, the Board of Revision of Assessments approved vacation of a portion of West Shore Court hereinafter more particulary described in accordance with the provisions of Article XIV, Section 28 of the Amended Charter of the City of Lakewood, and WHEREAS, this Council is satisfied that there is good cause for vacating a portion of West Shore Court and that it will not be deterimental to the general interest and ought to be made, and WHEREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the following described property be and the same is hereby vacated: SITUATED in the City of Lakewood, County of Cuyahoga and State of Ohio and known as being a part of Sublot No. 12 in the J. J. Donovan Realty Co's Subdivision of Block "A" of The Hiram Barrett Re-Subdivision of a part of Original Rockport Township Section No. 22, as Recorded in Volume 35 Page 15 of Cuyahoga County Map Records and bounded and described as follows: Beginning at an iron pipe set in the Southeasterly corner of said Sublot No. 12, thence Westerly along the Southerly line of said SUblot No. 12, a distance of 80 feet to the Southwesterly corner of said Sublot No. 12; thence Northerly along the Westerly line of said Sublot No. 12, a distance of 15.50 feet; thence Easterly and parallel with the Southerly line of said Sublot No. 12 and distant 15.50 feet at right angles Northerly therefrom, a distance of 80 feet to the Easterly line of said Sublot No. 12; thence Southerly along the Easterly line of said Sublot No. 12~ a distance of 15.50 feet to the place of beginning. Be the same more or less, but subject to all legal highways. Section 2. That the Clerk of Council be and she is hereby authorized and directed to notify the Auditor of Cuyahoga County of the vacation of the hereinbefore described property by forwarding to him a certified copy of the within ordinance together with a duly certified vacation plat.
