ORDINANCE NO: 61-87 <br /> <br />BY: Brown, Chinnock, Gallagher, <br /> Graham, McBride, Salmon, <br /> Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing the Public Works <br />Director to advertise for bids and to enter into a contract <br />with the lowest and best bidder after advertisement according <br />to law for the installation of a bypass sewer at the Lakewood <br />Wastewater Treatment Plant. <br /> <br /> WHEREAS, Council has been advised that a plant permit <br />requirement of the Ohio Environmental Protection Agency <br />necessitates the installation of a bypass sewer to handle <br />excess storm water flows, and <br /> <br /> WHEREAS, the construction drawings and specifications <br />have been approved by the Lakewood Engineering Department, <br />and <br /> <br /> WHEREAS, the aforementioned construction drawings <br />and specifications are now on file in the Office of the City <br />Engineer, and <br /> <br /> WHEREAS, this Ordinance constitutes an emergency <br />measure providing for the usual daily operation of a municipal <br />department and for the immediate preservation of the public <br />safety and welfare; now, therefore <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That the Public Works Director be and <br />he is hereby authorized and directed to advertise for bids <br />and to enter into a contract with the lowest and best bidder <br />after advertisement according to law for the installation <br />of a bypass sewer at the Lakewood Wastewater Treatment Plant <br />pursuant to plans and specifications on file in the Office <br />of the City Engineer. <br /> <br /> Section 2. That the cost of such construction is <br />estimated at $165,000, which funds are to be made available <br />from the Wastewater Treatment Plant Improvement Fund. <br /> <br /> Section 3. It is found and determined that all <br />formal actions of this Council concerning and relating to <br />the passage of this ordinance were adopted in an open meeting <br />of this Council, and that all such deliberations of this Council <br />and of any of its committees that resulted in such formal <br />action, were in meetings open to the public, in compliance <br />with all legal requirements. <br /> <br /> Section 4. That this Ordinance is hereby declared <br />to be an emergency measure for the reasons stated in the <br />preamble hereof and provided it receives the affirmative vote <br />of two-thirds of all members elected to Council, it shall <br />take effect and be in force immediately <br />and approval by the Mayor; otherwise <br />and be in force after the earliest p~ <br /> <br />Adopted:~ c~/ /~ ~ <br /> <br />Approved'.~ ~// /' <br /> <br /> upon its z~lo.~t~ion <br />it shall ~ effect <br /> <br /> <br />
