ORDINANCE NO: 80-87 <br /> <br />BY: Brown, Chinnock, Gal lagher, <br /> Graham, Salmon, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing <br />the Mayor ex-officio Director of Public Safety to issue <br />a permit to The Lakewood Association of Antique Dealers <br />(Attached Exhibit A) on Saturday, September 26 and as <br />a rain date Saturday, October 3 between the hours of 10:00 <br />A. M. and 6:00 P. M. <br /> <br /> WHEREAS, this ordinance constitutes an emergency <br />measure providing for the usual daily operation of a <br />municipal department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br />STATE OF OHIO: <br /> <br /> Section 1. That notwithstanding the provision of <br />Section 1667.17 of the Regional Building Code and the <br />provision of Section 901.18 of the Streets and Public <br />Services Code of the Codified Ordinances of the City of <br />Lakewood, the Mayor, as ex-officio Director of Public <br />Safety, be and he is hereby authorized and directed to <br />issue a permit to The Lakewood Association of Antique <br />Dealers (Attached Exhibit A) to conduct a sidewalk sale <br />in the City on Saturday, September 26 and as a rain date <br />Saturday, October 3, between the hours of 10:00 A. M. <br />and 6:00 P. M. No more than fifty per cent (50%) of the <br />sidewalk width abutting participating stores shall be <br />occupied by displays, which occupied ]portion of the sidewalk <br />shall be that portion immediately adjacent to the principal <br />structure. If the sidewalk to the curb is less than <br />eight-feet (8'), a minimum of four-feet (4') of the sidewalk <br />to the curb must remain unoccupied by the display for <br />pedestrian traffic. <br /> <br /> Section 2. It is found and determined that all formal <br />actions of this Council concerning and relating to the <br />passage of this ordinance were adopted in an open meeting <br />of this Council, and that all such deliberations of this <br />council and of any of its committees that resulted in <br />such formal action were in meetings open to the public <br />in compliance with all legal requirements. <br /> <br /> Section 3. That this ordinance is hereby declared <br /> to be an emergency measure for the reasons stated in the <br /> preamble hereof and provided it receives the affirmative <br /> vote of two-thirds of all members of Council, it shall <br /> take effect and be in force immediately upon its adoption <br /> and approval by the Mayor; otherwise, it shall take effect <br /> and be in force after the earlies~e~~by law. <br /> <br /> Adopted: ~ ~/~ ~~ ~'~ <br /> <br />App rove d~f~_~ ~!/~? <br /> <br /> <br />
