That the MUNICI?ALITY agrees to deposit with the Treasurer of Cuyahoga County the MUNICIPALITY'S-share of the es{imated cost of the project or agrees to enter into an escrow agreemenT. ~i'th. the Board of County Commissioners prior to an award of a contract for the improvement, That the COUNTY reserves the right to approve for participation any and all costs associated w'~th the preparation of plans and specifications for the improvement in accordance with current COUNTY policies. Four (4) copies of a formal fee proposal, including a detailed scope of services outlining all the work to be performed by the engineer, shall be submitted to the County for approval prior..to the County approving the hiring of the engineer. Further, the MUNICIPALITY will not authorize the engineer employed for this improvement to begin activities of any phase of work which is 'financed in part with County funds without the written approval of the COUNTY. Further, the COUNTY reserves the right to approve any and all invoices. submitted to the MUNICIPALITY by the aforesaid engineer for such phases of work which are to be financed in part by County funds prior to the release of those funds from the MUNICIPALITY to the consulting engineer. Section 4. MAINTENANCE That upon completion of said improvement said MUNICIPALITY will thereafter keep said highway open to traffic at all times; and 1. Maintain the improvement in accordance with the provisionsof the statutes relating thereto and make ample financial provisions for such maintenance; and 2. Maintain the ~ight-of-way and keep it free of obstructions in a manner satisfactory to the County and hold said right-of-way inviolate for public highway purposes and permit no signs, posters, billboards, roadsid~ stands or other private installations within the right-of-way limits; and 3. That the COUNTY shall contidu~'-tb maintain the structural elements of an~ bridge (defined as a structure with a span of twenty feet or greater) located within the limits of the improvement in accordance with the apolicable sections of the Ohio Revised Code. It is upderstood and agreed that the roadway pavement, curbs, sidewalk, lighting system, traffic control devices and other appurtenances do not comprise the structural elements of a bridge. Section 5. TRAFFIC That upon completion of said improvement said MUNICIPALITY wi¥1 thereafter keep said highway open to traffic at all times; and Place and maintain all traffic control devices conforming to the Ohio Manual of_~Uniform Traffic Control Devices on the improvement in compliance with the provisions of Section 4511.11 and related sections of the Ohio Revised Code, The street or highway shall be and hereby is designated a through highway as provided in Section 4511.07 (F) Ohio Revised Code. The Municipality shall prohibit~ parking as it deems necessary within the limits of the roadway constructed under this contract with the corporate limits of the Muhicipality.
