That the MUNICI?ALITY agrees to deposit with the Treasurer of Cuyahoga <br /> County the MUNICIPALITY'S-share of the es{imated cost of the project or <br /> agrees to enter into an escrow agreemenT. ~i'th. the Board of County <br /> Commissioners prior to an award of a contract for the improvement, <br /> That the COUNTY reserves the right to approve for participation any and <br /> all costs associated w'~th the preparation of plans and specifications for <br /> the improvement in accordance with current COUNTY policies. Four (4) <br /> copies of a formal fee proposal, including a detailed scope of services <br /> outlining all the work to be performed by the engineer, shall be submitted <br /> to the County for approval prior..to the County approving the hiring of the <br /> engineer. <br /> Further, the MUNICIPALITY will not authorize the engineer employed for <br /> this improvement to begin activities of any phase of work which is <br /> 'financed in part with County funds without the written approval of the <br /> COUNTY. <br /> Further, the COUNTY reserves the right to approve any and all invoices. <br /> submitted to the MUNICIPALITY by the aforesaid engineer for such phases of <br /> work which are to be financed in part by County funds prior to the release <br /> of those funds from the MUNICIPALITY to the consulting engineer. <br /> <br /> Section 4. MAINTENANCE <br /> That upon completion of said improvement said MUNICIPALITY will <br />thereafter keep said highway open to traffic at all times; and <br /> <br />1. Maintain the improvement in accordance with the provisionsof the statutes <br /> relating thereto and make ample financial provisions for such maintenance; <br /> and <br /> <br />2. Maintain the ~ight-of-way and keep it free of obstructions in a manner <br /> satisfactory to the County and hold said right-of-way inviolate for public <br /> highway purposes and permit no signs, posters, billboards, roadsid~ stands <br /> or other private installations within the right-of-way limits; and <br /> <br />3. That the COUNTY shall contidu~'-tb maintain the structural elements of an~ <br /> bridge (defined as a structure with a span of twenty feet or greater) <br /> located within the limits of the improvement in accordance with the <br /> apolicable sections of the Ohio Revised Code. It is upderstood and agreed <br /> that the roadway pavement, curbs, sidewalk, lighting system, traffic <br /> control devices and other appurtenances do not comprise the structural <br /> elements of a bridge. <br /> <br /> Section 5. TRAFFIC <br /> That upon completion of said improvement said MUNICIPALITY wi¥1 <br />thereafter keep said highway open to traffic at all times; and <br /> <br />Place and maintain all traffic control devices conforming to the Ohio <br />Manual of_~Uniform Traffic Control Devices on the improvement in compliance <br />with the provisions of Section 4511.11 and related sections of the Ohio <br />Revised Code, <br />The street or highway shall be and hereby is designated a through highway <br />as provided in Section 4511.07 (F) Ohio Revised Code. <br /> <br />The Municipality shall prohibit~ parking as it deems <br />necessary within the limits of the roadway constructed <br />under this contract with the corporate limits of the <br />Muhicipality. <br /> <br /> <br />
