ORDINANCE NO. 1-88 I:Jy: Brown, Chinnock, Gal lagher, Gazzana, George, Graham, Wendling AN EMERGENCY ORDINANCE to amend sections 523.04 and 523.05 of chapter 523 of the General Offenses Code of the Codified Ordinances of the City of Lakewood to correct typographical errors in the Lakewood Clean Indoor Air Ordinance. WHEREAS, that the Council of the City of Lakewood has found through the adoption of the Lakewood Clean Indoor Ordinance on September 8, 1987 that tobacco smoke is a major contributor to indoor air pollution, and WHEREAS, two typographical errors haw) been discovered in the Lakewood Clean Indoor Air Ordinance that was adopted by Council, and WHEREAS, this ordinance constitutes an emergency measure providing for. the immediate preservation of the public health, safety and welfare; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That Section 523.04 of the General Offenses Code of the Codified Ordinances of the City of Lakewood now reading as follows: 523.04 EXEMPTIONS The restrictions in 523.02 and 523.04 shall not apply to: shall be and the same is hereby amended to read as follows: 523.04 EXEMPTIONS. That Section 523.05 of the General Offenses Code of the Codified Ordinances of the City of Lakewood, now reading as follows: 523.05 Designation of Smoking Areas. Smoking areas may be designated in accordance with the provisions of this section by proprietors, employers in charge of places within Sections 523.02 (b) and (c), except in places in which smoking is otherwise prohibited by law. shall be and the same is hereby amended to read as follows: 523.05 DESIGNATION OF SMOKING AREAS Smoking areas may be designated in accordance with the provisions of this section by proprietors, employers in charge of places within Sections 523.02 (b) and 523.03 (c), except in places in which smoking is otherwise prohibited by law. It is found and determined that all formal action of this of this Council concerning and relating to the passage of this ordinance were adopted at an open meeting of this Council, and that all such deliberations of this Council and any of its committees that resulted in such formal action, were in meetings open to the public and in compliance with all legal requirements.
