ORDINANCE NO. 16-88 BY: Brown, Chinnock, Gallagher, Gazzana, George, Graham, Wendling AN EMERGENCY ORDINANCE establishing fees for the use of the Lakewood Municipal Jail Facility by other governmental entities for the incarceration of prisoners and authorizing the Director of Finance to invoice the governmental entities using said facilities. WHEREAS, the City of Lakewood has in the past cooperated with other governmental entities in the housing of prisoners on a short term basis and the City of Lakewood has absorbed the cost of housing such prisoners, and WHEREAS, it is no longer economically feasible to absorb the costs to house such przsoners and it is the recommendation of the Chief of Police that these other governmental entities be charged $75.00 per day to house such prisoners in the Lakewood MUnicipal Jail partially covering the cost of confinement, and WHEREAS, this ordinance constitutes an emergency measure providing for the usual daily operation of a municipal department; now therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD. OF OHIO: STATE SECTION 1. That the Administrative Code of the Codified Ordinances of the City of Lakewood is hereby supplemented by enacting new Section 127.02 thereof to read as follows: 127.02 CONFINEMENT COST REIMBURSEMENT - GOVERNMENT ENTITIES (a) Governmental Entities shall pay to the City for the use of the Lakewood Municipal Jail Facility for the housing of prisoners the sum of $75.00 per day per prisoner. (b) The Chief of Police and/or his designee shall ke~p an accurate record of the use of the Lakewood Municipal Jail by other governmental entities and forward a copy of this record to the Director of Finance on a monthly basis. (c) The Director of Finance shall promptly invoice the governmental entities using said facility and is authorized and directed to accept any and all monies for use of the Lakewood Municipal Jail Facility and such funds shall be paid into the general fund. SECTION 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements.
