FIRST AI~ENDI~EI~T TO AGREEI~ENT This first amendment to Agreement made this day of , 19 , by and between the Cities of Bay Village, Ohio; Lakewood, Ohio; Rocky River, Ohio; Fairview Park, Ohio; North Olmsted, Ohio and Westlake, Ohio. WITNESSETH: WttEREAS, the parties hereto have entered into that certain Agreement dated 19 ; and ' WHEREAS, It is the desire of the six Westshore Communities that are members of the Westshore Council of Governments to create the Westshore Hazardous Material Committee of; and WHEREAS, the establishment of this Committee will enable the Westshore Council of Governments to respond to hazardous waste spills in the Westshore area; and WHEREAS, the establishment of a hazardous material response unit by the Westshore Hazardous Material Committee will enhance the safety, welfare and livelihood of the residents of the six Westshore Communities that are members of the Westshore Council of Governments. NOW, THEREFORE, in consideration of the provisions herein and intending to be legally bound, the parties hereto agree as follows: 1. Recitals - The above recitals are incorporated in this First Amendment to Agreement as though set forth in full. 2. Amendment - Article IX of the Agreement entitled Wes~shore Enforcement Bureau is hereby deleted in its entirety and the following is substituted therefore, as though originally set forth therein: IX. WESTSHORE ENFORCEMENT BUREAU AND WESTSHORE HAZARDOUS MATERIAL COMMITTEE. In order to provide a greater degree of cooperation in the field of law enforcement and hazardous material spill mitigation, the Council hereby establishes the Westshore Enforcement Bureau and Westshore Hazardous Material Committee. The membership of the Bureau shall consist of the police chiefs of each member municipality or their alternates specifically designated by them. The membership on the committee shall consist of the fire chiefs of each member municipality and one member appointed from each of the following groups: The Council, Westshore Police Chiefs, Service Directors and Medical Directors. The Bureau and the Committee shall have authority to adopt their own rules and bylaws to govern their proceedings, subject to approval of the Council. Financial responsibility for the Westshore Enforcement Bureau and Westshore Hazardous Material Committee shall rest on the fiscal officer for the Council. No terms and conditions of any contract of the Bureau or Committee shall be binding on any participating municipality unless approved by the legislative body of that municipality. 3. Ratification - The Agreement is hereby ratified and confirmed except as modified herein.
