ORDINANCE NO. 19-88 By:Brown, Chinnock~ Gallagher, <br /> Gazzana, G~orge~ Graham, Wend]Jng <br /> AN EMERGENCY ORDINANCE con~ending the Board of Trustees <br />including the Mayor and members of City Council who served as Hospital <br />Trustees for successfully concluding a settlement agreement with Blue <br />Cross & Blue Shield Mutual of Ohio and authorizing and directing the <br />Mayor to sign said agreement between the City of Lakewood, the <br />Lakewood Hospital Association and Blue Cross & Blue Shield Mutual of <br />Ohio. <br /> <br />WHEREAS, a settlement agreement (Agreement) between the <br />Hospital Association (Hosp~taI) and Blue Cross & Blue Shield <br /> <br />Lakewood <br />Mutual of Ohio (Blue Cross) assures: (a) that community residents who <br />are Blue Cross subscribers can continue to obtain quality, affordable <br />health care and acute care hospital services at Lakewood Hospital <br />until at least January 1, 1995; (b) that home health care services of <br />the Hospial can be provided to Blue Cross subscribers; and (c) that <br />health care services of Lakewood Hospital are availale to other Blue <br />Cross subscribers who are members of Blue Cross health maintenance <br />organizations and preferred provider organizations; and· <br /> <br /> WHEREAS, the Hospital Board of Trustees has approved the <br />Agreement with Council representatives and the Mayor expressing their <br />concurrence by joining in the unanimous vote to adopt the Agreement, <br />and <br /> <br />"model for <br /> consumers" <br /> 21, 1987, <br /> <br /> WHEREAS, the Agreement has been hailed as a <br />others that should benefit everyone including, of course, <br />by The Plain Dealer in an editorial in its September <br />edition, and <br /> <br /> WHEREAS, all other approvals have been received including <br />the approval of the Ohio Supreme Court, Court of Appeals of Ohio, <br />Eighth Appellate District and the Cuyahoga County Court of Common <br />Pleas, and the Agreement has been duly executed by Blue Cross and the <br />Hospital, and <br /> <br /> WHEREAS, since the Hospital was owned and operated by the <br />City as a municipal hospital at the time the controversy commenced, <br />the City of Lakewood has been made a necessary party to the Agreement, <br />which should now be executed by the Mayor on behalf of the City, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public health, safety <br />and welfare in that the health care services described above may be <br />assured at the earliest possible time; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br /> <br />OF OHIO: <br /> <br /> Section 1. That this Council commends the Board of Trustees <br />of Lakewood Hospital Association, including the Mayor and the members <br />of this Council who served as Hospital Trustees, for successfully <br />concluding an Agreement with Blue Cross. <br /> <br /> Section 2. That this Council of the City of Lakewood hereby <br />approves the Agreement in the form now on file with the Clerk of <br />Council of the City of Lakewood and the Mayor is hereby authorized and <br />directed to execute said Agreement on behalf of the City. <br /> <br /> Section 3. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />ordinance were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action were in meetings open to the <br />public in compliance with all legal requirements. <br /> <br />1 <br /> <br /> <br />
