ORDINANCE NO. 19-88 By:Brown, Chinnock~ Gallagher, Gazzana, G~orge~ Graham, Wend]Jng AN EMERGENCY ORDINANCE con~ending the Board of Trustees including the Mayor and members of City Council who served as Hospital Trustees for successfully concluding a settlement agreement with Blue Cross & Blue Shield Mutual of Ohio and authorizing and directing the Mayor to sign said agreement between the City of Lakewood, the Lakewood Hospital Association and Blue Cross & Blue Shield Mutual of Ohio. WHEREAS, a settlement agreement (Agreement) between the Hospital Association (Hosp~taI) and Blue Cross & Blue Shield Lakewood Mutual of Ohio (Blue Cross) assures: (a) that community residents who are Blue Cross subscribers can continue to obtain quality, affordable health care and acute care hospital services at Lakewood Hospital until at least January 1, 1995; (b) that home health care services of the Hospial can be provided to Blue Cross subscribers; and (c) that health care services of Lakewood Hospital are availale to other Blue Cross subscribers who are members of Blue Cross health maintenance organizations and preferred provider organizations; and· WHEREAS, the Hospital Board of Trustees has approved the Agreement with Council representatives and the Mayor expressing their concurrence by joining in the unanimous vote to adopt the Agreement, and "model for consumers" 21, 1987, WHEREAS, the Agreement has been hailed as a others that should benefit everyone including, of course, by The Plain Dealer in an editorial in its September edition, and WHEREAS, all other approvals have been received including the approval of the Ohio Supreme Court, Court of Appeals of Ohio, Eighth Appellate District and the Cuyahoga County Court of Common Pleas, and the Agreement has been duly executed by Blue Cross and the Hospital, and WHEREAS, since the Hospital was owned and operated by the City as a municipal hospital at the time the controversy commenced, the City of Lakewood has been made a necessary party to the Agreement, which should now be executed by the Mayor on behalf of the City, and WHEREAS, this ordinance constitutes an emergency measure providing for the immediate preservation of the public health, safety and welfare in that the health care services described above may be assured at the earliest possible time; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That this Council commends the Board of Trustees of Lakewood Hospital Association, including the Mayor and the members of this Council who served as Hospital Trustees, for successfully concluding an Agreement with Blue Cross. Section 2. That this Council of the City of Lakewood hereby approves the Agreement in the form now on file with the Clerk of Council of the City of Lakewood and the Mayor is hereby authorized and directed to execute said Agreement on behalf of the City. Section 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. 1
