(b) "Pit bull dog" as used herein is hereby defined <br />as any Straffordshire Bull Terrier, American Pit Bull Terrier, <br />American Straffordshire Terrier breed of dog; any dog of mixed <br />breed which has the appearance and characteristics of being <br />predominantly of such breeds; or any dog commonly known as pit <br />bulls, pit bull dogs, or pit bull terriers; or a combination of <br />any of these breeds. <br /> <br /> (c) In the event of a dispute as to whether .a dog is <br />a pit bull dog, the health commissioner shall make the determi- <br />nation with or without a hearing, and the burden of proof that <br />such dog is not a pit bull dog shall be upon the owner or <br />custodian. <br /> <br />506. 13 POLICE DOGS EXEMPT. <br /> <br /> The terms "dangerous animal" and "vicious animal" as <br />used in this Chapter 506 does not include a police dog that has <br />been trained and may be used to assist law enforcement officers <br />in the performance of their official duties. <br /> <br />506.99 PENALTIES. <br /> <br /> (a) Whoever violates §506.01 to §506.12 is guilty of <br />a minor misdemeanor on a first offense and a misdemeanor of the <br />fourth degree on each subsequent offense. <br /> <br /> (b) If a violation of §506.01 to §506.12 involves an <br />animal designated by the Health Commissioner after a hearing to be a <br />dangerous animal, whoever violates such Section is guilty of a <br />misdemeanor of the third degree. <br /> <br /> (c) If a violation of §506.01 to §506.12 involves an <br />animal designed by the Health Commissioner after a hearing lo be a <br />vicious animal, whoever violates such Section is guilty of a <br />misdemeanor of the second degree. <br /> <br /> (d) If a violation of §506.01 to §506.12 involves an <br />animal designated by the Health Commissioner after a hearing either to <br />be a dangerous animal or a vicious animal, and if the animal <br />kills or seriously injures a human being, whoever violates such <br />Section is guilty of a misdemeanor of the first degree. <br /> <br /> Section 2. Existing Section 505.17 of the General <br />Offenses Code of the Codified Ordinances of the City of Lakewood, <br />entitled "Vicious Dogs", shall be and the same is hereby <br />repealed. <br /> <br /> Section 3. It is found and determined that all <br />formal actions of this Council concerning and relating to the <br />passage of this ordinance were adopted in an open meeting of this <br />Council, and that all such'deliberations of this Council and of <br />any of its committees that resulted in such formal action were in <br />meetings open to the public in compliance with all legal <br />requirements. <br /> <br />6 <br /> <br /> <br />
