ORDINANCE NO. 39-88 BY: Brown, Chinnock, Gazzana, George, Graham, Wend]ing AN EMERGENCY ORDINANCE authorizing and directing, the Director of Public Works to enter into a contract with Brom Truck, Inc. fOr the purchase of four glider kits to refurbish four Division of Refuse packer trucks, without competitive bidding. WHEREAS, pursuant to Ordinance Nos. 10-88 and 11-88, funds were appropriated and authorization approved for the purchase of four glider kits to refurbish four Division of Refuse packer trucks, and WHEREAS, said glider kits are only available from one source and, consequently the formal advertising for bids is impractical, and WHEREAS, Section 111.04(a)(10) provides that contracts under circumstances where Council determines that it is impractical to award the contract under competitive bidding procedures may be awarded without competitive bidding, and WHEREAS, a proposal has been received from Brom Truck, Inc. to provide four Complete Crane Carrier Glider Kits which proposal is hereby determined to be reasonable and in the best interest of the City to accept such proposal, and WHEREAS, this ordinance constitutes an emergency measure in that the refurbishing of the packer trucks should be started at the earliest possible, and it provides for the usual daily operation of a municipal department; now, therefore, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. It is hereby determined that Complete Crane Carrier Glider Kits is non-competitive and cannot be secured from any other source other than Brom Truck, Inc., 5281 Engle Road, Brook Park, Ohio 44142; therefore, the Director of Public Works is hereby authorized and directed to enter into a written contract with Brom Truck, Inc. on the basis of its proposal dated March 24, 1988, in the sum of approximately $156,000.00, a copy of said proposal being attached hereto as Exhibit "A" and made a part hereof as if fully rewritten herein. Section 2. That the costs of such kits shall be paid the Capital Improvement Fund. from Section 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. Section 4. That this ordinance is hereby declared to be an emergency measure for the reasons stated in the preamble hereof and provided it receives the affirmative vote of two-thirds of all members elected to Council, it shall take effect and be in force immediately upon its adoption and approval by the Mayor; otherwise, it shall take effect and be in force after the earliest period allowed by law.
