ORDINANCE NO.40-88 BY: Brown, Chinnock, Gazzana, <br /> George, Graham, Wend]lng <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the <br />Director of Public Works to enter into a contact with Road Machinery <br />Sales, Inc. for the reconditioning of four Division of Refuse packer <br />trucks without competitive bidding. <br /> <br />were <br />four <br />and <br /> <br /> WHEREAS, pursuant to Ordinance Nos. 10-88 and 11-88, funds <br />appropriated and authorization was approved for the purchase of <br />glider kits to refurbish four Division of Refuse packer trucks, <br /> <br /> WHEREAS, the refurbishing of said trucks requires a complete <br />reconditioning of the truck bodies which in turn can only be done by <br />Road Machinery Sales, Inc., the franchise dealer for Leach Corporation <br />in this area, and <br /> <br /> WHEREAS, Section 111.04(a)(10) provides that contracts under <br />circumstances where Council determines that it is impractical to award <br />the contract under competitive bidding procedures may be awarded <br />without competitive bidding, and <br /> <br /> WHEREAS, a proposal has been received from Road Machinery <br />Sales, Inc. for the complete reconditioning of the four packer trucks <br />dated November 2, 1987, in the amount of $28,116.36 which proposal is <br />reasonable and it is in the best interest of the City to accept such <br />proposal, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure in <br />that the complete reconditioning of the four Division of Refuse packer <br />trucks should be started at the earliest possible time, and it <br />provides for the usual daily operation of a municipal department; now, <br />therefore, <br /> <br />OF OHIO: <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE <br /> <br /> Section 1. It is hereby determined that the complete <br />reconditioning of the four Division of Refuse packer trucks is non- <br />competitive and can only be done by Road Machinery Sales, Inc, 33620 <br />Pin Oak Parkway, Avon Lake, Ohio, 44012; therefore, the Director of <br />Public Works is hereby authorized and directed to enter into a written <br />contract with Road Machinery Sales, Inc. on the basis of its proposal <br />dated November 2, 1987, in' the amount of $28,116.36, a copy of said <br />proposal being attached hereto as Exhibit "A" and made a part hereof <br />as if fully rewritten herein. <br /> <br /> Section 2. That the costs for such service shall be <br />from the Capital Improvement Fund. <br /> <br />paid <br /> <br /> Section 3. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />ordinance were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action were in meetings open to the <br />public in compliance with all legal requirements. <br /> <br /> Section 4. That this ordinance is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and <br />provided it receives the affirmative vote of two-thirds of all members <br />elected to Council, it shall take effect and be in force immediately <br />upon its adoption and approval by the MaYOr; otherwise, it shall take <br />effect and be in force after the earliest period allowed by law. <br /> <br />Adopted: ~/~ ~/ <br /> <br />PRESIDENT <br /> <br /> <br />
