ORDINANCE NO. 54-88 <br /> <br />BY: Brown, Chinnock, Gal lagher, Gazzana, <br /> George, Graham, Wendling <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the <br />Mayo~ ex-officio Directo~ of Public Safety to issue a permit to <br />Brigadoon Gifts located at 14813 Madison Avenue, to conduct a <br />sidewalk sale at 14813 Madison Avenue on Monday, July 11; <br />Tuesday, July 12; Wednesday, July 13; Thursday, July 14; Friday, <br />July 15; and Saturday, July 16, 1988, between the hours of 10:00 <br />a.m. and 6:00 p.m. <br /> WHEREAS, this ordinance constitutes an emergency <br /> measure providing for the usual daily operation of a municipal <br /> department; now, therefore, <br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, <br /> STATE OF OHIO: <br /> Section 1. That notwithstanding the provision of <br /> Section 1667.17 of the Regional Building Code and the provision <br /> of Section 901.18 of the streets and Public Services code of the <br /> Codified Ordinances of the City of Lakewood, the Mayor, as ex- <br /> officio Director of Public Safety, be and is hereby authorized <br /> and directed to issue a permit to Brigadoon Gifts located at <br /> 14813 Madison Avenue, to conduct a sidewalk sale in the City on <br /> Monday, July 11; Tuesday, July 12; Wednesday, July 13; Thursday, <br /> July 14; Friday, July 15; and Saturday, July 16, 1988, between <br /> the hours of 10:00 a.m. and 6:00 p.m. No more than fifty percent <br /> (50%) of the sidewalk width abutting the participating store <br /> shall be occupied by displays, which occupied portion of the <br /> sidewalk shall be that portion immediately adjacent to the <br /> principal structure. <br /> Section 2. It is found and determined that all formal <br /> actions of this Council concerning and relating to the passage of <br /> this ordinance were adopted in an open meeting of this Council, <br /> and that all such deliberations of this Council and of any of its <br /> committees that resulted in such formal action were in meetings <br /> open to the public in compliance with all legal requirements. <br /> Section 3. That this ordinance is hereby declared to <br /> be an emergency measure for the reasons stated in the preamble <br /> hereof and provided it receives the affirmative vote of two- <br /> thirds (2/3) of all members elected to Council, it shall take <br /> effect and be in force immediately upon its adoption and approval <br /> by the Mayor; otherwise, it shall take effect and be in force <br /> after the earliest period allowed by law. <br /> <br />Adopted: <br /> <br />PRESIDENT <br /> <br /> <br />
