<br /> AN EMERGENCY ORDINANCE authorizing and directing the Mayor
<br />ex-officio Director of Public Safety to issue a permit to Cherub Antiques,
<br />16310 Detroit Avenue; Encore, 16500 Detroit; Lakewood Antique Mall, 16928 Detroit;
<br />Royal Iris, 1386 Bonnieview; Antique Corner, 17100 Detroit; Federal House, 17106
<br />Detroit; Rose-N-Sons, 17128 Detroit; Rose-N-Sons II, 17122 Detroit; and Granger
<br />City Antiques, 17923 Detroit to conduct a sidewalk sale on Saturday, September
<br />24, 1988 {with a rain date of Saturday, October 1, 1988) between the hours
<br />of Noon and 5 P.M~
<br />
<br /> WHEREAS, this ordinance constitutes an emergency measure providing
<br />for the usual daily operation of a municipal department; now, therefore,
<br /> BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF
<br />OHIO:
<br />
<br /> Section 1. That notwithstanding the provision of Section 1667. 17
<br />of the Regional Building Code and the provision of Section 901.18 of the
<br />Streets and Public Services Code of the Codified Ordinances of the City of
<br />Lakewood, the Mayor, as ex-officio Director of Public Safety, be and he is
<br />hereby authorized and directed to issue a permit to Cherub Antiques, Encore,
<br />Lakewood Antique Mall, Royal Iris, Antique Corner, Federal House, Rose-N-Sons,
<br />Rose-N-Sons II, and Granger City Antiques, to conduct a sidewalk sale in the
<br />City on Saturday, September 24, 1988,(with a rain date of Saturday, October
<br />1, 1988 ) between the hours of Noon and 5 P.M. No more than fifty per cent
<br />(50%) of the sidewalk width abutting participating stores shall be occupied
<br />by displays, which occupied portion of the sidewalk shall be that portion
<br />immediately adjacent to the principal structure.

<br /> Section 2. It is found and determined that all formal actions of
<br /> this Council concerning and relating to the passage of this ordinance were
<br /> adopted in an open meeting of this Council, and that all such deliberations
<br /> of this Council and of any of its committees that resulted in such formal
<br /> action were in meetings open to the public in compliance with all legal
<br /> requirements.

<br /> Section 3. That this ordinance is hereby declared to be an
<br /> emergency measure for the reasons stated in the preamble hereof and provided
<br /> it receives the affirmative vote of two-thirds (2/3) of all members of
<br /> Council, it shall take effect and be in force immediately upon its adoption
<br /> and approval by the Mayor; otherwise, it shall take effect and be in force
<br /> after the earliest period allowed by law.
