(d) Rental permits issued pursuant to this section <br />may be revoked by the Mayor after notice and <br />hearing for any of the following causes: <br /> <br />{1) <br /> <br />(2) <br /> <br />(3) <br /> <br /> Fraud, misrepresentation or any false <br /> statement contained in the application for <br /> such a permit; <br />Violation of any provisions of ordinances <br />regulating such rental permit; or <br />Violation of the terms of the rental permit <br />granted. Notice of hearing for such a <br />revocation shall be given in writing stating <br />the grounds of the complaint together with <br />the time and place of hearing and shall be <br />mailed postage prepaid to the permittee at <br />the address given in the rental permit <br />application at least five days prior to the <br />date set for hearing. <br /> <br />(e) A person aggrieved by a decision of the Mayor <br />in refusing to grant or revoking a rental permit <br />shall have the right to appeal to Council. Such <br />appeal shall be taken by filing a notice of appeal <br />including a statement of the grounds for the appeal <br />with the Clerk of Council within ten days after <br />notice of the decision by the Mayor has been given. <br />Council shall set the time and place for hearing <br />such appeal and notice of such time and place shall <br />be given in the same manner as specified <br />hereinabove. Council shall have the power to <br />reverse, affirm or modify the decision of the Mayor <br />and any such decision made by Council shall be <br />final. <br /> <br />be and the same hereby is repealed and amended to read as follows: <br /> <br /> 901.181 NEWSPAPER DISPENSING DEVICES, PERMIT AND <br /> APPLICATION. <br /> <br />(a) Applications and Permits: ApPlications may be <br />made to and on forms'approved by the Mayor for <br />rental permits allowing the installation of <br />newspaper dispensing devices on public property <br />along the streets and thoroughfares within the City <br />respecting newspapers having general circulation <br />throughout the City. Upon a proper application, <br />the Mayor shall grant said permit subject to the <br />following terms and conditions: <br />(1) The term "newspaper dispensing device", as <br /> used in this section shall mean a mechanical <br /> coin operated container constructed of metal <br /> or other material of a substantially <br /> equivalent strength and durability, not more <br /> than fifty (50) inches in height and not more <br /> than twenty-five (25) inches in length and <br /> width. <br />(2) Notwithstanding any other section of the <br /> Codified Ordinances or action by any 'Board of <br /> the City, the following minimum provisions <br /> shall be contained in any .standards enacted <br /> for such devices: <br /> The device shall be a color that <br /> matches identically a color'selected by the <br /> City which is part of the' general color <br /> scheme for all stru6tures located on" public <br /> right-of-ways or thoroughfares, including, <br /> but not limited to RTA bus shel~ers and <br /> telephone booths; the device sh~ll be <br /> permitted to have the logo of the newspaper <br /> contained therein on three sides, the price <br /> <br />5 <br /> <br /> <br />
