ORDINANCE NO. 95-88 <br /> <br />BY:Brown, Chinnock, Gallagher, Gazzana, George, <br /> Graham, Wendllng <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Director of <br />Public Works to enter into a contract with Brom Truck, Inc. for the <br />purchase of one glider kit to refurbish Division of Refuse Packer <br />Truck #427, without competitive bidding. <br /> WHEREAS, said glider kits are only available from one source and, <br />consequently the formal advertising for bids is impractical, and, <br /> WHEREAS, Section 111.04 (a)(lO) provides that contracts under <br />circumstances where Council determines that it is impractical to award <br />the contract under competitive bidding procedures may be awarded <br />without competitive bidding, and, <br /> WHEREAS, an emergency condition exists which, if not corrected, <br /> could pose a significant hazard to the public health, safety and <br /> welfare, and, <br /> WHEREAS, this Ordinance constitutes an emergency measure providing <br /> for the immediate preservation of the public health, safety and <br /> welfare and for the usual daily operation of a municipal department; <br /> now, therefore, <br /> BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. It is hereby determined that under Section 111.04 of <br /> the Codified Ordinances, it is impractical to award said contract <br /> under competitive bidding procedures in that the Complete Crane Carrier <br /> Glider Kits cannot be secured from any other source than Brom Truck, <br /> Inc. 5281 Engle Road, Brook Park, OH 44142; and an emergency situation <br /> exists effecting the public health, safety and welfare, therefcre, the <br /> Director of Public Works is hereby authorized and directed to enter <br /> into a written contract with Brom Truck, Inc. for the purchase of one <br /> (1) Glider Kit for Refuse Packer #427, in an amount not exceeding <br /> $4o,ooo. <br /> Section 2. That such contract be in the form as provided in <br /> Section 111.04 (a)(lO) of the Codified Ordinances of the City of <br /> Lakewood and provided such contract is approved by the Board of <br /> Control. <br /> Section 3. It is found and determined that all formal actions of <br /> this Council concerning and relating to the passage of this Ordinance <br /> were adopted in an open meeting of this Council, and that all such <br /> deliberations of this Council and of any of its committees that <br /> resulted in such formal action were in meetings open to the public in <br /> compliance with all legal requirements. <br /> Section 4. That this Ordinance is hereby declared to be an <br /> emergency measure for the reasons stated in the preamble hereof and <br /> provided it receives the affirmative vote of two-thirds of all members <br /> elected to Cotncil, it shall take effect and be in force immediately <br /> upon its adoption and approval by the Mayor; otherwise, it shall take <br /> effect and be in force after the earliest period allowed by law. <br /> <br />/ <br /> <br /> <br />
