ORDINANCE NO: 29-89 <br /> <br />BY:Brown, Chinnock, Gallagher <br />George, Graham, Wendling <br /> <br /> An emergency ordinance enacted by the City of Lakewood __, <br /> Cu[~_h_~_ ...... Cotmty, Ohio, in the tatter of the hereinafter described improvement <br />and to request cooperation by the Director of Transportation. <br /> <br /> WHRREAS, the City ]ma identified the need for and proposes the improve~ent of a portion of the <br />public highway which is described as follows: <br /> <br />Construct a slope stabilization system along Riverside' Drive (SK 237) from <br />approximately Hogs Back ~ane, the southerly corporation line of the City, to <br />Graber Drive in the City of Lakewood, a distance of 0.95 miles more or less. <br /> <br /> said portion of highway within the municipal corporatioa limits being hereinafter referred to <br />as the improvement, m~d <br /> <br /> WHEREAS, the City further desires cooperation from the Director of Transportation in th~ <br />planning, design and construction of' said improvement. <br /> <br /> WHER[AS, this Ordinance constitutes an emergency measur~ providing' for the <br /> preservation of the health, welfare and safety of Lakewood Citizens, <br /> <br /> NO~ THEREFORE, Be it ordained by <br />Ohio: <br /> <br />the City of Lake~po.d. -_, <br /> <br />SECTION I (Cooperation) <br /> That said City hereby requests the cooperation of the Director of Transportation in the <br />cost of the above described improvement as follows: <br /> The Department of Transportation will assume and bear fifteen percent (15Z) of <br /> the Federal participating portion of the improvement. <br /> The City does hereby agree to assume and contribute the ~ntire cost and expense <br /> of the improvement less the amount of Federal-aid funds set aside by the Director <br /> of Transportation for the financing of this improvement from funds allocated by <br /> the Federal Highway Administration, United States Department of Transportation, <br /> and less the amount of the non-Federal share:de~ermined to be eligible for State <br /> Highway funds. <br /> <br />SECTION 1I (Consent) !- <br /> That it is declared to be in the public interest that the consent of said City be and <br />such co.sent is hereby given to the Director of Transportation to construct the above described <br />improve,eat, in accordance with plans, specifications and es~timates as approved by the Director. <br /> <br />SECTION III (Authority to Sign) <br /> of laid City, i~ hereby empowered <br /> That the' - ............ <br />and directed ~-behalf of tt~e City to enter into agreements with the Director of Transportation <br />necessary to complete the planning and construction of this improvement. <br /> <br />SECTION IV (Traffic Control Signals and Devices) <br /> That traffic control devices installed within the limits of the pr°~ect will conform with Section <br />4511 of the Ohio Nevised Code. <br /> <br />Page 1 of 3 <br /> <br /> <br />
