ORDINANCE NO: 29-89 BY:Brown, Chinnock, Gallagher George, Graham, Wendling An emergency ordinance enacted by the City of Lakewood __, Cu[~_h_~_ ...... Cotmty, Ohio, in the tatter of the hereinafter described improvement and to request cooperation by the Director of Transportation. WHRREAS, the City ]ma identified the need for and proposes the improve~ent of a portion of the public highway which is described as follows: Construct a slope stabilization system along Riverside' Drive (SK 237) from approximately Hogs Back ~ane, the southerly corporation line of the City, to Graber Drive in the City of Lakewood, a distance of 0.95 miles more or less. said portion of highway within the municipal corporatioa limits being hereinafter referred to as the improvement, m~d WHEREAS, the City further desires cooperation from the Director of Transportation in th~ planning, design and construction of' said improvement. WHER[AS, this Ordinance constitutes an emergency measur~ providing' for the preservation of the health, welfare and safety of Lakewood Citizens, NO~ THEREFORE, Be it ordained by Ohio: the City of Lake~po.d. -_, SECTION I (Cooperation) That said City hereby requests the cooperation of the Director of Transportation in the cost of the above described improvement as follows: The Department of Transportation will assume and bear fifteen percent (15Z) of the Federal participating portion of the improvement. The City does hereby agree to assume and contribute the ~ntire cost and expense of the improvement less the amount of Federal-aid funds set aside by the Director of Transportation for the financing of this improvement from funds allocated by the Federal Highway Administration, United States Department of Transportation, and less the amount of the non-Federal share:de~ermined to be eligible for State Highway funds. SECTION 1I (Consent) !- That it is declared to be in the public interest that the consent of said City be and such co.sent is hereby given to the Director of Transportation to construct the above described improve,eat, in accordance with plans, specifications and es~timates as approved by the Director. SECTION III (Authority to Sign) of laid City, i~ hereby empowered That the' - ............ and directed ~-behalf of tt~e City to enter into agreements with the Director of Transportation necessary to complete the planning and construction of this improvement.
