PLACED ON FIRST RENDING and <br />referred to COMMI~OF!THE WHOLE <br />and RULES & ORDINANCES CMTE on 6/6/~ <br />and SECOND READING on 6/19/89. <br /> <br />ORDINANCE NO. <br /> <br />37-89 <br /> <br />BY: Brown, Gallagher, <br /> George, Graham, Wendltng <br /> <br /> AN EMERGENCY ORDINANCE providing for the submission to <br />the electors of the City a proposed amendm~,nt to the Amended <br />Charter of the City of Lakewood to require that all meetings of <br />City Council or its Committees called for the purpose of <br />transacting public business, when a majority of the members of <br />Council are present, be open to the public unless an Executive <br />Session is called pursuant to the Ohio Revised Code for certain <br />specific purposes. <br /> <br /> WHEREAS, pursuant to the Amended Charter of the City <br />and the Constitution of the State of Ohio, the Council has <br />determined to authorize and direct the submission to the electors <br />of the City of Lakewood the proposed Charter amendment <br />hereinafter set forth, at the general and regular municipal <br />election to be held on November 7, 1989, which election is not <br />less than 60 nor more than 120 days from the date of passage of <br />this ordinance; and <br /> <br /> WHEREAS, the City Council has seen the need from time <br />to time to meet in Executive Sessions to consider personnel <br />matters, collective bargaining issues, sale or purchase of real <br />estate, or pending or imminent litigation and other matters <br />required or permitted to be kept confidential by federal or state <br />law and'consistent with the State of Ohio Sunshine Law contained <br />in Section 121.22 of the Ohio Revised Code; and <br /> <br /> WHEREAS, this Council by two-thirds vote of the <br />members elected thereto determines that this ordinance is an <br />emergency measure providing for the immediate preservation of the <br />public peace, property, health and safety and for the further <br />reason that this ordinance must be effective in order to permit <br />the election herein called to be held on the date specified in <br />this ordinance; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD: <br /> <br /> Section 1. That this Council hereby authorizes and <br />directs the submission to the electors of the City of Lakewood at <br />the general and regular municipal election to be held at the <br />usual places of voting in the City on Tuesday, November 7, 1989, <br />of the following proposal to amend the Amended Charter of the <br />City. <br /> <br /> That Section 5 of Article III of the Amended Charter <br />of the City of Lakewood now reading as follows: <br /> <br /> SECTION 5. ORGANIZATION <br /> The Council shall be the judge of the election <br />and qualification of its members. A majority of all <br />the acting members elected shall be a quorum to do <br />business but a less number may adjourn from day to <br />day and compel the attendance of absent members in <br />such manner and under such penalties as may be <br />prescribed by ordinance. The affirmative vote of a <br />majority of the acting members of Council shall be <br />necessary to adopt any ordinance or resolution and <br />on the passage thereof a vote shall be taken by yeas <br />and nays and entered upon the journal. The Council <br />shall determine its own rules and order of business <br />and shall keep a journal of its proceedings. <br /> <br /> <br />
