ORDINANCE NO. <br /> <br />60-89 <br /> <br /> BY: Brown,..Chinmock, Gallagher, <br />Gazzana, Ge.0rge', Gr.aham, Wendling <br /> <br /> AN EMERGENCY ORDINANCE to vacate that portion of the public <br />right of way situated north of 14013 Detroit Avenue in the City of <br />Lakewood, Ohio. <br /> <br /> WHEREAS, on the 17th day of July, 1989, the Council of the <br />City of Lakewood adopted Resolution No. 6387-89 declaring its intent <br />to vacate a portion of the public right of way situated north of 14013 <br />Detroit Avenue, and <br /> <br /> WHEREAS, notice of the adoption of the above Resolution No. <br />6387-89 has been served upon the owners of all of the property <br />abutting Detroit Avenue affected by said resolution notifying said <br />property owners of the time and place at which objections could be <br />heard before the Board of Revision of Assessments, and <br /> <br /> WHEREAS, on the 29th day of August, 1989, the Board of <br />Revision of Assessments approved vacation of a portion of the public <br />right of way situated north of 14013 Detroit Avenue hereinafter more <br />particulary described in accordance with the provisions of Article <br />XIV, Section 28 of the Amended Charter of the City of Lakewood, and <br /> <br /> WHEREAS, this Council is satisfied that there is good cause <br />for vacating a portion of the public right way situated north of 14013 <br />Detroit Avenue, and that it will not be deterimental to the general <br />interest and ought to be made, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the usual daily operation of a municipal department; <br />now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the following described property be and the <br />same is hereby vacated: <br /> <br />SITUATED in the City of Lakewood, County of <br />Cuyahoga and State of Ohio and known as being a <br />part of Original Rockport Township Section No. 22 <br />and further known as being part of Detroit Avenue, <br />widened to 100 feet, as shown by the plat recorded <br />in Volume 121, Page 40 of Cuyahoga County Map <br />Records, being bounded and described as follows: <br /> <br />Beginning at a drill hole set on the southerly line <br />of Detroit Avenue at its intersection with the <br />easterly line of Parkhaven Row, 50 feet wide, as <br />shown on said recorded plat; thence N 86°50'00"E, <br />109.81 feet along the southerly line of Detroit <br />Avenue to a 'drill hole set at an angle point <br />therein; thence S 83°16'07"E, 91.93 feet along the <br />southerly line of Detroit Avenue to a drill hole <br />set, said point is 100.65 feet measured along said <br />southerly line from its intersection with the <br />westerly line of Bunts Road, 60 feet wide; thence N <br />31°51'12"W, 3.54 feet to a drill hole set; thence N <br />83°16'07"W, 61.16 feet to a drill hole set; thence <br />S 89°47'33"W, 29.10 feet to a point in said <br />southerly line of Detroit Avenue; thence N <br />83°16'07"W, 1.47 feet along said southerly line to <br />said angle point therein; thence S 86°50'00"W, 3.44 <br />feet along said southerly line of Detroit Avenue; <br />thence S 89°47'33"W, 40.01 feet to a drill hole <br />set; thence S 85°03'08"W, 66.45 feet to the place <br />of beginning. <br /> <br />1 <br /> <br /> <br />
