or processer to knowingly sell, offer for sale or expose <br />for sale an irradiated food to a hospital, medical <br />clinic, physician or physicians office for use as part <br />of a medical regimen in the care or treatment of persons <br />with i~'~m~un= .~t~'.~t deflcienc~ or other disease, provided <br />the irradiated food is packaged with or accompanied by <br />a warning label that it is intended for medical use only <br />by such persons upon physicians advice. <br /> <br />1753.03 APPLICABILITY. <br /> <br />The provisions of this Section shall not apply to <br />irradiated foods purchased prior to the effective date <br />of this section. <br /> <br />1753.04 EFFECTIVENESS. <br /> <br />This act shall take for enforcement effect on the 120th <br />day after it shall have taken effect under the Amended <br />Charter ofthe City of Lakewood. <br /> <br />1753.99 PENALTIES. <br /> <br />Whoever violates any provision of this Chapter shall be <br />guilty of a misdemeanor of the third degree. If the <br />offender has been previously convicted of a violation of <br />this Chapter, such second or subsequent offense shall <br />constitute a misdemeanor of the second degree. <br /> <br /> Section 2. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />ordinance were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action were in meetings open to the <br />public in compliance with all legal requirements. <br /> <br /> Section 3. That this ordinance is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and <br />provided it receives the affirmative vote of two-thirds of all members <br />elected to Council, it shall take effect and be in force immediately <br />upon its adoption and approval by the Mayor; otherwise, it shall take <br />effect and be in force after the earliest period allowed by law. <br /> <br />PRESiDENT <br /> <br />2 <br /> <br /> <br />
