ORDINANCE NO. 16-90 BY: Boscia, Gallagher, George, Graham, <br /> Roth, Smith <br /> <br /> AN EMERGENCY ORDINANCE approving a Collective Bargaining <br />Agreement with Ohio Council 8 and Local 1043 of the American <br />Federation of State, County and Municipal Employees AFL-CIO, <br />establishing conditions of employment, working conditions and <br />various benefits for certain employees of the Department of Public <br />Works of the City of Lakewood, and authorizing the Mayor to sign <br />said Agreement on behalf of the City. <br /> a prior Collective Bargaining Agreement entered <br /> Whereas, City of Lakewood and Ohio Council 8 and Local <br /> into between the <br /> 1043 of the American Federation of State, County and Municipal <br /> Employees AFL-CIO, terminated on February 28, 1990, and <br /> Whereas, discussions and negotiations have been continued <br /> subsequently on behalf of the City with representatives of Local <br /> Union 1043 and Ohio Council 8 with respect to conditions of <br /> employment, working conditions and various benefits for certain <br /> employees of the Department of Public Works of the City of <br /> Lakewood, and <br /> Whereas, an agreement has been reached in the course of <br /> said discussions and negotiations with respect to the conditions of <br /> employment, working conditions and various benefits for certain <br /> employees aforementioned, and <br /> Whereas, this Council determines that it is in the best <br /> interest of the City to approve said Collective Bargaining <br /> Agreement and authorize the Mayor to sign same on behalf of the <br /> City of Lakewood, and <br /> Whereas, this ordinance constitutes an. emergency measure <br /> providing for the immediate preservation of the public health, <br /> safety and welfare and for the usual daily operation of a municipal <br /> department and further for the reason that it is necessary to <br /> approve said Agreement at the earliest possible time; now, <br /> therefore, <br /> BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. That the Collective Bargaining Agreement with <br /> Ohio- Council 8 and Local 1043 of the American Federation of State, <br /> County and Municipal Employees AFL-CIO, effective for the period of <br /> January 1, 1990, through December 31, 1992, an original copy of <br /> which is on file in the office of the Mayor of the City of Lakewood <br /> and is made a part hereof as though written fully herein, is hereby <br /> adopted, ratified and approved and the Mayor is hereby authorized <br /> and directed for and on behalf of the City of Lakewood to affix his <br /> signature thereto. <br /> Section 2. That all- other ordinances or resolutions or <br /> parts of ordinances or resolutions which are inconsistent with the <br /> provisions of this ordinance and/or the Collective Bargaining <br /> Agreement made a part hereof, are hereby repealed as of <br /> January 1, 1990, to the extent that they pertain to the employees <br /> in the bargaining unit covered by the Collective Bargaining <br /> Agreement and are inconsistent with this ordinance, including the <br /> Collective Bargaining Agreement referred to herein and made a part <br /> hereof. <br /> Section 3. It is found and determined that all formal <br /> actions of this Council concerning and relating to the passage of <br /> this ordinance were adopted in an open meeting of this Council, <br /> and that all such deliberations of this Council and of any of its <br /> committees that resulted in such formal action were in meetings <br /> open to the public in compliance with all legal requirements. <br /> Section 4. That this ordinance is hereby declared to be <br /> an emergency measure for the reasons stated in the preamble hereof <br /> <br /> <br />
