ORDINANCE NO. 37-90 <br /> <br />BY: Boscia, Gallagher, <br />GaZzana, George, Koth <br /> <br /> AN EMERGENCY ORDINANCE amending Chapter 565. of the Codified <br />Ordinances of the City of Lakewood by enacting new Section 565.50 <br />entitled Gift-A-Tree Program, establishing a Gift-A-Tree Program for <br />the City of Lakewood. <br /> <br /> WHEREAS, the establishment of a Gift-A-Tree Program provides <br />interested people with the opportunity to purchase, a living <br />memorial/gift/recognition which shades, beautifies and purifies the <br />environment of the City of Lakewood, and <br /> <br /> WHEREAS, the establishment of a Gift-A-Tree Program is in <br />the best interest of all citizens of our community by improving our <br />community aesthetically and by perpetuating efforts for a cleaner <br />environment, and <br /> <br /> WHEREAS, the trees in our community have always been <br />important asset contributing both to the quality of life and <br />maintenance and improvement of our environment, and <br /> <br /> an <br />the <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public health, safety <br />and welfare and for the usual daily operation of a municipal <br />department; now, therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, .STATE OF OHIO: <br /> <br /> Section 1. That Chapter 565 of the Lakewood Codified <br />Ordinances is hereby amended and supplemented by enacting new Section <br />565.50 entitled Gift-A-Tree Program, to read as follows: <br /> <br />565.50 GIFT-A-TREE PROGRAM. <br /> <br />There is hereby established in and for the City of <br />Lakewood a Gift-A-Tree Program which shall be <br />administered by the Director of Public Works, the <br />records of which shall be administered by the <br />Director of Finance. <br /> <br />(a) The Director of Finance shall establish a <br />separate designated fund maintained in accordance <br />with applicable City finance procedures to receive <br />cash donations to the Gift-A-Tree Program. <br /> <br />(b) Donations shall be recorded by the name of the <br />donor, the date and donation amount. All such <br />donations shall be used solely for the purchase and <br />placement of .trees in the City of Lakewood. <br />Donations may also include trees in lieu of money. <br /> <br />(c) Ail trees shall be purchased by the Director <br />of Public Works in accordance with appropriate <br />ordinances of the City of Lakewood. Siting, <br />planting and maintenance of trees will be the <br />responsibility of and at the sole discretion of the <br />Director of Public Works. The Director of Public <br />Works is hereby authorized to adopt rules and <br />regulations as necessary to implement this Program. <br /> <br />(d) Donations will be acknowledged by a personal <br />letter to the individual honored, a representative <br />of the individual memorialized, and the donor <br />notified as appropriate. The Director of Finance <br />shall cause a Gift-A-Tree Program record book to be <br />created, acknowledging donations, honorariums and <br />memorials.
