Please substitute for Ordinance <br />No. 44-90 placed on FIRST <br />READING 5/7/90 and placed on <br />SECOND READING 6/4/90. <br /> <br />ORDINANCE NO. 44-90 BY: B0scia, GaTlagher, George, <br /> Graham, Roth, Smith <br /> AN EMERGENCY ORDINANCE providing a rate schedule for use of <br />the pistol range in the Police Headquarters of the City of Lakewood. <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the usual daily operation of a municipal department; <br />now therefore, <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the following rates shall be charged <br />organizations for the use of the police pistol range located in the <br />Police Headquarters in the City of Lakewood: <br /> <br />Up to 4 hours or any <br />part thereof <br /> <br />$200.00 <br /> <br />In excess of 4 hours up <br />to 8 hours or any part thereof <br /> <br />$400.00 <br /> <br /> Section 2. Use of the police pistol range shall be limited <br />to organizations employing, or certified to train, law enforcement <br />personnel, public or private. <br /> <br /> Section 3. The Chief of Police may, at his discretion, <br />waive all or part of payment of fees provided for in Section 1 of this <br />ordinance for governmental agencies, including, but not limited to, <br />organizations such as the FBI, Department of Immigration, Internal <br />Revenue Service and the United States Coast Guard if the agency has <br />a reciprocal use agreement with the Lakewood Police Department. <br /> <br /> Section 4. Ail rentals of the police pistol range shall be <br />subject to the approval of the Chief of Police and the use of such <br />range shall be subject to rules and regulations as may be from time to <br />time established by the Chief of Police, subject to the approval of <br />the Director of Public Safety. <br /> <br /> Section 5. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of <br />this ordinance were adopted in an open meeting of this Council, and <br />that all such deliberations of this Council and of any of its com- <br />mittees that resulted in such formal action were in meetings open to <br />the pUblic, in compliance with all legal requirements. <br /> <br /> Section 6. This ordinance is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof, and <br />provided it receives the affirmative vote of two-thirds of all members <br />elected to Council, it Shall take effect and be in force immediately <br />upon its adoption and approval by the Mayor; otherwise, <br /> <br />effect and be in force after the earl' peri d allowed <br /> CLERK <br /> <br />Approved: <br /> <br />e <br /> <br /> <br />
