ORDINANCE NO: 46-90 <br /> <br /> By:Boscia, Gallagher, <br />Gazzana, George, Graham, Roth, Smith <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Mayor ex-officio <br />Director of Public Safety to issue a permit to the Lakewood Antique Mall <br />at 16928 Detroit Avenue on June 9, 1990, between the hours of noon and 5 <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure providing <br />for the usual daily operation of a municipal department; now, therefore, <br /> <br />BE IT ORDAINED BY THE COUNCIL OF THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That notwithstanding the provision of Section 1667.17 of <br />the Regional Building Code and the provision of Section 901.18 of the <br />Streets and Public Services Code of the Codified Ordinances of the City of <br />Lakewood, the Mayor, as ex-officio Director of Public Safety, be and he is <br />hereby authorized and directed to issue a permit to The Lakewood Antique <br />Mall to conduct a sidewalk sale in the City on Saturday, June 9, 1990 <br />between the hours of noon to 5 P.M. No more than fifty per cent (50%) of <br />the sidewalk width abutting the participating store shall be occupied by <br />displays, which occupied portion of the sidewalk shall be that portion <br />immediately adjacent to the principal structure. If the sidewalk to the <br />curb is less than eight-feet (8'), a minimum of four-feet (4') of the <br />sidewalk to the curb must remain unoccupied by the display for pedestrian <br />traffic. <br /> <br /> Section 2. It is found and determined that all formal actions of <br />this Council concerning and relating to the passage of this ordinance were <br />adopted in an open meeting of this Council, and that all such <br />deliberations of this Council and of any of its committees that resulted <br />in such formal action were in meetings open to the public in compliance <br />with all legal requirements. <br /> <br /> Section 3. That this ordinance is hereby declared to be an emergency <br />measure for the reasons stated in the preamble hereof and provided it <br />receives the affirmative vote of two-thirds of all members of Council, it <br />shall take effect and be in force immediately upon its adoption and <br />approval by the Mayor; otherwise, it shall take effect and be in force <br />after the earliest period allowed by law. <br /> <br />Adopted: <br /> <br />Clerk <br /> <br />Approved: ~~2~/ /~fO ~ - <br /> <br /> <br />
