ORDINANCE NO. S7-90 BY: <br /> <br />Gallagher, Gazzana, George, <br /> Graham, Roth, Smith <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Mayor <br />ex-officio Director of Public Safety to issue a permit to the twelve (12) <br />downtown Lakewood merchants )isted on the attached Exhibit A, to conduct <br />a sidewalk sa)e at the corresl~nd~mg addresses listed on this attached <br />Exhibit on Thursday, J~)y 5; Friday, July 6; and Saturday, July 7, 1989, <br />between the hours of noon amd! 6:00 p.m. <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the usual dai)y operation of a municipal department; now <br />therefore, ' <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That notwithstanding the provision of Section <br />1667.17 of the Regional Building Code and the provision of Section 901.18 <br />of the Streets and Public Services Code of the Codified Ordinances of the <br />City of Lakewood, the Mayor, as ex-officio Director of Public Safety, be <br />and he is hereby authorized and directed to issue a permit to the twelve <br />(12) downtown Lakewood merchants listed on the attached Exhibit A, in the <br />City on Thursday, July 5; Friday, July 6; and Saturday, July 7, 1989, <br />between the hours of noon and 6:00 p.m. No more than fifty percent (50%) <br />of the sidewalk width abutting participating stores shall be occupied by <br />displays, which occupied portion of the sidewalk shall be that portion <br />immediately adjacent to the principal structure. If the sidewalk to the <br />curb is less than eight-feet (8'), a minimum of four-feet (4') of the <br />sidewalk to the curb must remain unoccupied by the display for pedestrian <br />traffic. <br /> <br /> Section 2. It is found and determined that all formal actions <br />of this Council concerning and relating to the passage of this ordinance <br />were adopted in an open meeting of this Council, and that all such <br />deliberations of this Council and of any of its committees that resulted <br />in such formal action were in meetings open to the public in compliance <br />with all legal requirements. <br /> <br /> Section 3. That this ordinance is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and <br />provided it receives the affirmative vote of two-thirds (2/3) of all <br />members of Council, it shall take effect and be in force 'immediately upon <br />its adoption and approval by theMayor; otherwise, it sba-l-~ake effect <br />and be in force after the earliest pe~ 1/~ <br /> <br />Adopted: ~ ~,/ <br /> <br />Approved:~ ~/ <br /> <br /> <br />
