hearing shall be set not later than 30 days after <br />the date of the filing of the Notice of Appeal, but <br />in no event shall such hearing be set for a date <br />subsequent to the date specified in the original <br />permit application for a permitted activity under <br />this section. The Clerk of Council shall notify <br />the appellant by having the Notice of ~earing <br />personally served upon the appellant at the address <br />specified in the permit application or by certified <br />mail at that address at the ~ole discretion of the <br />Clerk. ' <br /> <br />Council shall have the power to reverse, affirm, or <br />modify the decision of the Director of Public <br />Works/Public Safety, any such decision made by <br />Council shall be final. <br /> <br />775.99 PENALTIES. <br /> <br /> Any person found to have violated any provision <br /> of this Section shall be guilty of a minor <br /> misdemeanor upon the first offense and a fourth <br /> degree misdemeanor upon any subsequent offense. <br /> <br /> Section 2. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />ordinance were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action were in meetings open to the <br />public in compliance with all legal requirements. <br /> <br /> Section 3. That this ordinance is hereby declared to be an <br />emergency measure for the reasons stated in the preamble hereof and <br />provided it receives the affirmative vote of two-thirds of all members <br />elected to Council, it shall take effect and be in force immediately <br />upon its adoption and approval by the Mayor; otherwise, it shall take <br />effect and be in force after the earliest <br /> <br />period allowe . <br /> aw <br /> <br />Approved,~ ~ ~ ~7// ~ ~ <br /> <br /> <br />
