ORDINANCE NO. <br /> <br />85-90 <br /> <br />PLACED ON FIRST READING and REFERRED to FINANCE <br />CMTB on OCTOBER 15, 1990, <br />PLACED ON SECOND READING on 11/19/90. <br /> BY: Boscia, Gallagher, George, <br /> Graham, Roth, Smith <br /> <br />and (e), <br />Codified <br />fines. <br /> <br />AN EMERGENCY ORDINANCE amending Section 351.99(b), (c), (d) <br />Section 353.99 and Section 355.99 of the Traffic Code of the <br />Ordinances of the City of Lakewood relating to all parking <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public health, safety <br />and welfare, and for the usual daily operation of a municipal <br />department; now, therefore, <br /> BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. That subsections (b), (c), (d) and (e) of <br /> Section 351.99 of the Traffic Code of the Codified Ordinances of the <br /> City of Lakewood now reading as follows: <br /> 351.99 PENALTY AND WAIVER. <br /> <br />(b) Whoever violates any of the provisions of <br />355.06(a), (b) or (c), or Chapter 353 may, in lieu <br />of other penalties provided for the violation of <br />such provisions and upon signing a waiver, be fined <br />three dollars ($3.00), if such violator pays such <br />fine at the Traffic Bureau, in person or by mail, <br />within forty-eight hours, or, if not within forty- <br />eight hours, then the sum of five dollars ($5.00) <br />if such violator pays such amount at the Traffic <br />Bureau, in person or by mail within seventy-two <br />hours from the time of violation. In the event <br />such violator does not pay the fine as hereinbefore <br /> provided, then a warrant shall be issued and such <br /> violator shall be subject to the penalties <br /> otherwise provided for the violation of such <br /> provisions. <br /> (c) Whoever violates Section 351.01(a) thorugh <br /> (p), (r) or (s) through Section 351.18 or Section <br /> 351.20(b) or (c) or Section 351.23(a), (b), (c) or <br /> (d) may, in lieu of the other penalties provided <br /> for the violation of such provisions and upon <br /> signing a waiver, be fined five dollars ($5.00) if <br /> such violator pays such fine at the Traffic Bureau, <br /> in person or by mail, within forty-eight hours, or <br /> if not within forty-eight hours, then in the sum of <br /> ten dollars ($10.00) if such violator pays such <br /> amount at the Traffic Bureau, in person or by mail, <br /> within seventy-two hours from the time of <br /> violation. In the event such violator does not pay <br /> the fine as hereinbefore provided, then a warrant <br /> shall be issued and such violator shall be subject <br /> to the penalties otherwise provided for the <br /> violation of such provisions. <br /> (d) Whoever violates Section 351.01(q) or Section <br /> 351.27 may, in lieu of the other penalties provided <br /> for the violation of such section and upon signing <br /> a waiver, be fined ten dollars ($10.00) if such <br /> violator pays such fine at the Traffic Bureau, in <br /> person or by mail, within forty-eight hours, or if <br /> not within forty-eight hours, then in the sum of <br /> fifteen dollars ($15.00) if such violator pays such <br /> amount at the Traffic Bureau, in person or by mail, <br /> within seventy-two hours from the time of the <br /> <br /> <br />
