ORDINANCE NO. 88-90 <br /> <br />BY: <br /> <br />Boscia, Gallagher, Gazzana, <br />George, Graham, Roth, Smith <br /> <br /> AN EMERGENCY ORDINANCE to amend Chapter 149 of the <br />Administrative Code of the Codified Ordinances of the City of Lakewood <br />to provide for compensation for employees of the City involuntarily <br />called to active duty for a National or State emergency. <br /> <br /> WHEREAS, Section 149.19 of the Administrative Code of the <br />Codified Ordinances of the City of Lakewood provides for military <br />leaves of absence and compensation for employees called to active duty <br />but does not provide for situations of long periods of active duty due <br />to national or statewide emegencies, and <br /> <br /> WHEREAS, this Council determines it to be in the public <br />interest to support the national defense by encouraging membership in <br />the Reserves of the United States Armed Forces and the Ohio National <br />Guard in order to contribute to our national defense and the welfare <br />of our state and community, and <br /> <br /> WHEREAS, the current situation in the Middle East brings to <br />light the need for support for the men and women of our Armed Forces, <br />particularly employees who are members of the Reserves and Guard, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency <br />providing for the immediate preservation of the public health, <br />and welfare; now, therefore, <br /> <br />measure <br /> safety <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Administrative Code of the Codified <br />Ordinances of the City of Lakewood shall be and the same are hereby <br />supplemented and amended by enacting new Section 149.19(c) to read as <br />follows: <br /> <br />149.19 MILITARY LEAVE; COMPENSATION. <br /> <br />(b) . . . <br /> <br />(c) Any employee of the City who is involuntarily <br />called to active duty for any National or State <br />emergency by order of the President of the United <br />States, the Congress of the United States, the <br />Governor of the State of Ohio or the Legislature of <br />the State of Ohio, shall be granted a leave of <br />absence for the duration of such active duty and <br />shall be paid the difference between his regular <br />pay and his military service or National Guard pay <br />for a period of not more than 365 days and shall <br />accumulate vacation, longevity and sick leave <br />credit and be entitled to all such other benefits <br />including health insurance during the period of <br />such leave of absence. <br /> <br /> Section 2. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />ordinance were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action were in meetings open to the <br />public in compliance with all legal requirements. <br /> <br /> <br />
