88-90 149.19 Provide compensation when called to active duty

ORDINANCE NO. 88-90 BY: Boscia, Gallagher, Gazzana, George, Graham, Roth, Smith AN EMERGENCY ORDINANCE to amend Chapter 149 of the Administrative Code of the Codified Ordinances of the City of Lakewood to provide for compensation for employees of the City involuntarily called to active duty for a National or State emergency. WHEREAS, Section 149.19 of the Administrative Code of the Codified Ordinances of the City of Lakewood provides for military leaves of absence and compensation for employees called to active duty but does not provide for situations of long periods of active duty due to national or statewide emegencies, and WHEREAS, this Council determines it to be in the public interest to support the national defense by encouraging membership in the Reserves of the United States Armed Forces and the Ohio National Guard in order to contribute to our national defense and the welfare of our state and community, and WHEREAS, the current situation in the Middle East brings to light the need for support for the men and women of our Armed Forces, particularly employees who are members of the Reserves and Guard, and WHEREAS, this ordinance constitutes an emergency providing for the immediate preservation of the public health, and welfare; now, therefore, measure safety BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Administrative Code of the Codified Ordinances of the City of Lakewood shall be and the same are hereby supplemented and amended by enacting new Section 149.19(c) to read as follows: 149.19 MILITARY LEAVE; COMPENSATION. (b) . . . (c) Any employee of the City who is involuntarily called to active duty for any National or State emergency by order of the President of the United States, the Congress of the United States, the Governor of the State of Ohio or the Legislature of the State of Ohio, shall be granted a leave of absence for the duration of such active duty and shall be paid the difference between his regular pay and his military service or National Guard pay for a period of not more than 365 days and shall accumulate vacation, longevity and sick leave credit and be entitled to all such other benefits including health insurance during the period of such leave of absence. Section 2. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements.
