conducted thereon or therewith until such time as the <br /> Redevelopment Properties are conveyed by the City to <br /> Redeveloper. Moreover, the City shall be responsible, at its <br /> sole cost, for the cure and removal of all adverse <br /> environmental conditions and/or problems discovered by <br /> Redeveloper in connection with any environmental audit of the <br /> Redevelopment properties or thereafter during the course of any <br /> site work or construction activities. Such undertaking and <br /> responsibility shall survive the Closing and the filing of the <br /> Deeds for record. In addition, any corrective action <br /> undertaken by the City shall be subject to the approval of <br /> Redeveloper,s Project. Engineers and consultants and any <br /> federal, state and/or local regulatory body having jurisdiction <br /> thereof. For purposes of this Agreement, "Hazardous Materials,, <br /> means and includes asbestos, radon and any hazardous substance <br /> or any pollutant or. contaminant defined as such in RCRA, <br /> <br />CERCLA, the Federal Water Pollution Control Act, the Clean Air <br />Act, or any other now and/or hereinafter existing federal, <br />state or local statute, law, ordinance, code, rule, regulation, <br />order or decree (as such statutes, laws,~ Ordinances, codes, <br />rules, regulations, 'orders or decrees may hereafter from time <br />to time be amended) regulating, relating to, or imposing <br />liability or standards of conduct concerning any hazardous, <br />toxic or dangerous waste, substance or material, as now or at <br />any time hereafter in effect.
