PURCHASE AGREEMENT <br /> <br /> This agreement is made this day of , <br />1990, by and between Glenn Gaewsky and Beth Gaewsky,~ <br />(hereinafter referred to as "Sellers") and the city of Lakewood, <br /> <br /> Lakewood, Ohio <br /> <br />a Municipal Corporation, 12650 Detroit Avenue, <br />(hereinafter referred to as "Buyer"). <br /> <br /> W I T N E S S E T H: <br /> <br /> WHEREAS, the City of Lakewood has determined that it is <br />in the public interest that it acquire certain real property <br />located at 1424-26 victoria Avenue, Lakewood, Ohio, hereafter <br />referred to as the "Property," and that the City will proceed to <br />take the property for a public-purpose by eminent domain if <br />necessary, therefore the Sellers~ under threat of eminent <br />domain, agree to sell and the buyer agrees to buy the Property, <br />which -is more particularly described in Exhibit "A" attached <br />hereto and incorporated by reference herein, together with all <br />Sellers' right, title and interest in and to the Property which <br />Sellers may have in said property, together with all <br />appurtenances thereto. Sellers shall have the right to remove <br />any appliances or fixtures they desire after the premises is <br />vacated by any tenant, as is agreed between the parties. <br /> <br /> NOW, THEREFORE, <br /> <br />promises, covenants and <br />other good and valuable <br /> <br /> in consideration of the mutual <br />agreements contained herein and for <br /> <br /> consideration, the receipt and <br /> <br />sufficiency of which are hereby acknowledged, the parties hereto <br />agree as follows: <br /> <br /> <br />
