PLACED ON FIRST READING and REFERRED <br />to FINANCE COMMITTEE 1/22/91. <br />PLACED ON SECOND READING 2/4/91. <br /> <br />ORDINANCE NO. 9-91 <br /> <br />BY: Boscia, Gallagher, Gazzana, <br /> George, Graham, Roth, Smith <br /> <br /> AN EMERGENCY ORDINANCE to amend Section 911.02 of the <br />Streets, Utilities and Public Services Code of the Codified Ordinances <br />of the City of Lakewood by enacting new Section 911.02(e). <br /> WHEREAS, the cost to the City's Refuse Division to remove, <br />transport and dispose of bulk items discarded by residents of the City <br />has increased dramatically as a result of increased cost of fuel and <br />landfill, and <br /> WHEREAS, the ability of the City to continue to provide this <br />valuable service to residents is jeopardized by the combination of <br />said cost increases and budgetary constraints, and <br /> WHEREAS, the appearance and value of both residential and <br />non-residential real property can best be maintained and enhanced by <br />continuing to provide this valuable service at a reasonable cost to <br />the residents of the City, and <br /> <br /> WHEREAS, it is necessary and desirable that the Director of <br />Public Works have the ability to set reasonable charges for the <br />recovery of the cost of removal, transportation and disposal of bulk <br />items and to establish, maintain and enforce reasonable standards for <br />the waiver of said charges in special circumstances, to include <br />without limitation hardship and natural disasters, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency measure <br />providing for the immediate preservation of the public health, safety <br />and welfare, and for the usual daily operation of a municipal <br />department; now, therefore, <br /> <br /> BE IT ORDAINED BY THE C1TY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. That Section 911.02 of the Streets, Utilities <br />and Public Services Code of the Codified Ordinances of the City of <br />Lakewood be amended by the enactment of new section 911.02(e) to read <br />as follows: <br /> <br />911.02 CHARGES. <br /> <br />(b) . . . <br /> <br />(d) . . · <br /> <br />(e) The Director of Public Works is hereby <br />authorized to establish a schedule of charges and <br />standards for the waiver of said charges in special <br />circumstances, for special pick up of bulk items to <br />compensate the City for the cost of removal, <br />transportation and disposal. <br /> <br /> Section 2. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />ordinance were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action were in meetings open to the <br />public in compliance with all legal requirements. <br /> <br />1 <br /> <br /> <br />
