ORDINANCE NO. <br /> <br />10-91 <br /> <br />BY: <br /> <br />Boscia, Gallagher, Gazzana, <br />George, Graham, Roth, Smith <br /> <br /> AN EMERGENCY ORDINANCE approving a Collective Bargaining <br />Agreement with Jailers and Ohio Labor Council, Fraternal Order of <br />Police, establishing conditions of employment, working conditions <br />and various benefits for certain employees of the Department of <br />Public Safety of the City of Lakewood, and authorizing the Mayor to <br />sign said Agreement on behalf of the City. <br /> Whereas, discussions and negotiations have been continued <br />subsequent on behalf of the City with representatives of the <br />Jailers and the Ohio Labor Council, Fraternal Order of Police, with <br />respect to conditions of employment, working conditions and various <br />benefits for certain employees of the Department of Public Safety <br />of the city of Lakewood, and <br /> Whereas, an agreement has been reached in the course of <br /> said discussions and negotiations with respect to the conditions of <br /> employment, working conditions and 'various benefits for certain <br /> employees aforementioned, and <br /> Whereas, this Council determines that it is the best <br /> interest of the City to approve said Collective Bargaining <br /> Agreement and authorized the Mayor to sign same on behalf of the <br /> City of Lakewood, and <br /> <br /> Whereas, this ordinance constitutes an emergency measure <br /> providing for the immediate preservation of the public health, <br /> safety and welfare and for the usual daily operation of a municipal <br /> department and further for the reason that it is necessary to <br /> approve said Agreement at the earliest possible time; now, <br /> therefore, <br /> BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> Section 1. That the Collective/Bargaining Agreement with <br /> Jailers and Ohio Labor Council, Fraternal Order of. Police effective <br /> for the period of March 1, 1990, through February 29, 1992, and <br /> original copy of which is on file in the office of the Mayor of the <br /> City of Lakewood and is made a part hereof as though written fully <br /> herein, is hereby adopted, ratified and approved and the Mayor is <br /> hereby authorized and directed for and on behalf of the City of <br /> Lakewood to affix his signature thereto. <br /> Section 2. That all other ordinances or resolutions or <br /> parts of ordinances or resolutions wi%ich are inconsistent with the <br /> provisions of this ordinance and/or the Collective Bargaining <br /> Agreement made a part hereof, are hereby repealed as of March 1, <br /> 1990, to the extent that they pertain to the employees in the <br /> bargaining unit covered by the Collective Bargaining Agreement and <br /> are inconsistent with this ordinance, including the Collective <br /> Bargaining Agreement referred to herein and made a part hereof. <br /> Section 3. It is found and determined that all formal <br /> actions of this Council concerning and relating to the passage of <br /> this ordinance were adopted in an open meeting of this Council, and <br /> that all such deliberations of this Council and of any of its <br /> committees that resulted in such formal action were in meetings <br /> open to the public in compliance with all legal requirements. <br /> Section 4. That this ordinance is hereby declared to <br /> be an emergency measure for the reasons stated in the preamble <br /> hereof and provided it receives the affirmative vote of two-thirds <br /> of all members elected to Council, it shall take effect and be in <br /> <br /> <br />
