ORDINANCE NO. <br /> <br />18-91 BY: <br /> <br />Boscia, Gallagher, Gazzana, <br />George, Graham, Roth, Smith <br /> <br /> AN EMERGENCY ORDINANCE authorizing and directing the Mayor, <br />on behalf of the City of Lakewood, to enter into an extension of the <br />contract with the Lakewood Board of Education which created a Lakewood <br />Child Care Services Director pursuant to Ordinance 49-88, as modified <br />and extended in Ordinance 64-89, for a period of one year and annual <br />renewals thereafter until terminated by action of this Council or the <br />Lakewood Board of Education. <br /> <br /> WHEREAS, our children are our most precious asset and <br />assistance in providing quality child care facilities and programs is <br />an essential element of the preservation of the future of our <br />community, and <br /> <br /> WHEREAS, this contract should be annually renewed so long as <br />the Lakewood Board of Education and this Council are satisfied with <br />the performance of the Director and the operation of her office, and <br /> WHEREAS, Council by annual appropriation can and does <br />adequately review the performance and appropriate level of funding for <br />this office, and <br /> <br /> WHEREAS, this ordinance constitutes an emergency <br />providing for the immediate preservation of the public health, <br />and welfare, and <br /> <br />measure <br /> safety <br /> <br />BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: <br /> <br /> Section 1. That the Mayor, on behalf of the City of <br />Lakewood be and he is hereby authorized and directed to enter into an <br />agreement extending the existing contract with the Lakewood Board of <br />Education for the establishment of the office of Lakewood Child Care <br />Services Director, said contract to contain the same provisions as <br />those presently existing save for the termination date and the amount <br />of funding by the City and such other terms and conditions as in the <br />judgment of the Director of Law are necessary for the clarification of <br />the rights, responsibilities and legal relationship of the parties. <br /> <br /> Section 2. That said extension shall contain the following <br />specific provisions and/or terms: <br /> <br /> 1. That the contract is extended through December 31, <br /> 1991, with funding in the year 1991 and thereafter as <br /> provided by appropriation ordinance of this Council for <br /> the Office of Lakewood Childcare Services Director. <br /> <br />That the extension agreement contain a provision <br />allowing termination of the Agreement effective <br />December 31, 1991, or on the last day of any renewal <br />year thereafter if Council elects not to fund said <br />office in the temporary appropriations ordinance <br />adopted for the first quarter of the following year or <br />effective March 31, 1991, or the 31st day of March of <br />any renewal year thereafter, if Council elects not to <br />fund said office for the balance of 1991 or the <br />respective renewal year in the final appropriations <br />ordinance enacted for the fiscal year. <br /> <br /> Section 3. It is found and determined that all formal <br />actions of this Council concerning and relating to the passage of this <br />ordinance were adopted in an open meeting of this Council, and that <br />all such deliberations of this Council and of any of its committees <br />that resulted in such formal action were in meetings open to the <br />public in compliance with all legal requirements. <br /> <br />1 <br /> <br /> <br />
