ORDINANCE NO. 18-91 BY: Boscia, Gallagher, Gazzana, George, Graham, Roth, Smith AN EMERGENCY ORDINANCE authorizing and directing the Mayor, on behalf of the City of Lakewood, to enter into an extension of the contract with the Lakewood Board of Education which created a Lakewood Child Care Services Director pursuant to Ordinance 49-88, as modified and extended in Ordinance 64-89, for a period of one year and annual renewals thereafter until terminated by action of this Council or the Lakewood Board of Education. WHEREAS, our children are our most precious asset and assistance in providing quality child care facilities and programs is an essential element of the preservation of the future of our community, and WHEREAS, this contract should be annually renewed so long as the Lakewood Board of Education and this Council are satisfied with the performance of the Director and the operation of her office, and WHEREAS, Council by annual appropriation can and does adequately review the performance and appropriate level of funding for this office, and WHEREAS, this ordinance constitutes an emergency providing for the immediate preservation of the public health, and welfare, and measure safety BE IT ORDAINED BY THE CITY OF LAKEWOOD, STATE OF OHIO: Section 1. That the Mayor, on behalf of the City of Lakewood be and he is hereby authorized and directed to enter into an agreement extending the existing contract with the Lakewood Board of Education for the establishment of the office of Lakewood Child Care Services Director, said contract to contain the same provisions as those presently existing save for the termination date and the amount of funding by the City and such other terms and conditions as in the judgment of the Director of Law are necessary for the clarification of the rights, responsibilities and legal relationship of the parties. Section 2. That said extension shall contain the following specific provisions and/or terms: 1. That the contract is extended through December 31, 1991, with funding in the year 1991 and thereafter as provided by appropriation ordinance of this Council for the Office of Lakewood Childcare Services Director. That the extension agreement contain a provision allowing termination of the Agreement effective December 31, 1991, or on the last day of any renewal year thereafter if Council elects not to fund said office in the temporary appropriations ordinance adopted for the first quarter of the following year or effective March 31, 1991, or the 31st day of March of any renewal year thereafter, if Council elects not to fund said office for the balance of 1991 or the respective renewal year in the final appropriations ordinance enacted for the fiscal year. Section 3. It is found and determined that all formal actions of this Council concerning and relating to the passage of this ordinance were adopted in an open meeting of this Council, and that all such deliberations of this Council and of any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements. 1
